(1) There is established by
this Act a Biodiversity Conservation Advisory Panel (the
"Advisory Panel" ).
(2) The function of the Advisory Panel is to advise the
Minister on any matter on which the Minister requests advice that relates to
the management of biodiversity conservation. The Advisory Panel also has the
function of advising the Environment Agency Head on any proposed declaration
of an area of outstanding biodiversity value.
(3) The Advisory Panel is
subject to the control and direction of the Minister in relation to the work
it undertakes, but is not subject to the control and direction of the Minister
in relation to the content of any advice given by the Advisory Panel.
(4) The
Advisory Panel is to consist of not less than 5, and not more than 8, members
appointed by the Minister. The members of the Advisory Panel are to have such
qualifications and expertise as the Minister considers appropriate for the
work of the Panel.
(5) The Minister is to appoint one of the members of the
Advisory Panel as the Chairperson of the Panel.
(6) The Advisory Panel may
consult with, obtain advice from, or request the assistance of any person who
has expertise relevant to the work of the Panel.
(7) The regulations may make
provision for or with respect to the members and procedure of the Advisory
Panel.
