BUILDING AND CONSTRUCTION INDUSTRY LONG SERVICE PAYMENTS ACT 1986 - SECT 46
Interest on, and extension of time for payment of, long service levies
46 Interest on, and extension of time for payment of, long service levies
(1) Any amount due in respect of a long service levy and not paid before the
due date for its payment shall bear interest at the rate prescribed by
subsection (4).
(2) Any such interest shall, except for the purpose of
calculating the amount of interest payable under subsection (1), be deemed to
form part of the unpaid long service levy and may be recovered as an amount
due in respect of a long service levy.
(3) The Corporation may, where it
considers that special circumstances warrant its doing so in any particular
case, direct: (a) that the due date for payment of any long service levy be
varied to such later date as may be specified in the direction, or
(b) that
the amount of any interest payable under subsection (1) be waived or be
reduced by such amount as may be specified in the direction,
and the direction
shall, notwithstanding anything to the contrary in this Act, have effect
according to its tenor.
(4) For the purposes of subsection (1), the
prescribed rate is: (a) except as provided by paragraph (b)-2 per cent per
calendar month, or part of a calendar month, or
(b) such other rate as is
prescribed by the regulations.
