Referral of questions of law by Local Court

30 Referral of questions of law by Local Court

(1) If, in proceedings before it under this Act, a question of law arises, the Local Court may decide the question or refer it to the Land and Environment Court for decision.
(2) If a question of law is referred to the Land and Environment Court by the Local Court, the Local Court must not make an order or decision to which the question is relevant until the Land and Environment Court has decided the question.
(3) On deciding the question, the Land and Environment Court must remit its decision to the Local Court and that Court must not proceed in a manner, or make an order or decision, that is inconsistent with the decision of the Land and Environment Court.
(4) A reference under this section is to be made in accordance with rules of the Land and Environment Court.
