Compulsory mediation of land dealing application disputes
239A Compulsory mediation of land dealing application disputes
(1) This section applies to a dispute relating to a decision by the
New South Wales Aboriginal Land Council under Division 4 of Part 2 to approve
or not to approve a land dealing . (2) A Local Aboriginal Land Council must,
if the Council proposes to commence legal proceedings in relation to the
dispute, refer the dispute to the Registrar . (3) The Registrar may, with the
parties consent-- (a) attempt to resolve the dispute by mediation,
conciliation or arbitration, or (b) refer the dispute to mediation,
conciliation or arbitration by an independent person.
