General provisions with respect to offences
42 General provisions with respect to offences
(1) Proceedings for an offence against a provision of this Act or the
regulations shall be disposed of summarily before the Local Court.
(1A) Any
such proceedings must be commenced not later than 2 years from when the
offence was alleged to have been committed.
(2) Any person who: (a) attempts
to commit, or conspires with or incites another person to commit, an offence
against a provision of this Act, or
(b) aids, abets, counsels or procures the
commission of any such offence by another person,
may be charged, tried,
convicted and punished as if the first-mentioned person had actually done or
omitted to do the act or omission that constitutes the offence, and, where any
such person is so convicted, that person shall, for all purposes, be deemed to
be convicted of an offence against this Act.
(3) The fact that an inspector
or a person acting under the authority or instructions of the Director-General
or an inspector has exercised a function, imposed or conferred by or under
this Act in relation to any matter concerning bees, beehives, apiary products
or appliances or the premises on which they are kept does not relieve a person
from a liability that the person may incur or have incurred under this Act to
be charged, dealt with and punished in relation to that matter.
