STATE RECORDS ACT 1998 - SECT 35
Public office entitled to return of records if needed
(1) If a record that is a State archive is required for use for official
purposes in the public office responsible for the record, the public office is
entitled to temporary custody of it while it is required for use.
(2) The
public office is not entitled to custody of the original record (unless the
Authority is satisfied that custody of the original is needed) and the giving
of custody of a copy of the record is sufficient to satisfy this section.
(3)
If custody of the original is needed it can be given subject to conditions
designed to ensure the safe keeping and proper preservation of the original.
(4) The Authority is entitled to charge a public office for the reasonable
expenses that the Authority incurs in giving the public office temporary
custody of a record under this section.
