Explanatory note

This explanatory note relates to this Bill as introduced into Parliament.

Overview of Bill

The object of this Bill is to repeal the South-west Tablelands Water Supply
Act 1924, the South-west Tablelands Water Supply Administration Act 1941
and regulations made under the latter Act and to enact appropriate
consequential provisions dealing with:

(a) transfer of the assets, rights and liabilities of the Administrator of the
South-west Tablelands Water Supply on the dissolution of that
statutory corporation, and
(b) transfer of staff attached to the South-west Tablelands Water Supply to
Goldenfields Water County Council, and
(c) amendment of the Capital Debt Charges Act 1957, and
(d) matters of a savings and transitional nature.

Explanatory note

Outline of provisions

Clause 1 sets out the name (also called the short title) of the proposed Act.

Clause 2 provides for the commencement of the proposed Act on a day or
days to be appointed by proclamation.

Clause 3 defines certain words and expressions used in the proposed Act.

Clause 4 deals with the transfer of the assets, rights and liabilities of the
Administrator of the South-west Tablelands Water Supply on the dissolution
of the statutory corporation. The clause also gives effect to proposed
Schedule 1 that applies to the transfer of assets, rights and liabilities under
the clause.

Clause 5 is a formal provision giving effect to proposed Schedule 2 that
deals with the transfer of staff attached to the South-west Tablelands Water
Supply to Goldenfields Water County Council with effect from the
commencement of the proposed Schedule.

Clause 6 repeals the South-west Tablelands Water Supply Act 1924, the
South-west Tablelands Water Supply Administration Act 1941 and the
South-west Tablelands Water Supply Administration (Price of Water)
Regulation 1994.

Clause 7 is a formal provision giving effect to the provisions of a savings or
transitional nature set out in proposed Schedule 3.

Clause 8 makes a consequential amendment to the Capital Debt Charges
Act 1957 to remove references to the Administrator of the South-west
Tablelands Water Supply and the South-west Tablelands Water Supply
Administration Act 1941 from the Schedule to that Act.

Schedule 1 sets out the provisions that are to apply to the transfer of assets,
rights and liabilities under the proposed Act.

Schedule 2 sets out the provisions that are to apply to the transfer of staff
under the proposed Act.

Schedule 3 sets out provisions of a savings or transitional nature consequent
on the enactment of the proposed Act.
