A Bill for
An Act to authorise the carrying out of the development known as the Designer
Outlets Centre on Orange Grove Road, Liverpool, with the consent of Liverpool City
Council.

The Legislature of New South Wales enacts: 1

1 Name of Act
This Act is the Save Orange Grove Act 2004. 3

2 Commencement
This Act commences on the date of assent. 5

3 Orange Grove development permitted with council consent
(1) Development may be carried out with the consent of Liverpool City 7
Council for the purposes of an outlets centre not exceeding 14,500 8
square metres in gross floor area on land comprising lot 121 in 9
Deposited Plan 876962 (known as the Designer Outlets Centre at 1216 10
Orange Grove Road, Liverpool). 11
(2) In this Act: 12
development has the same meaning as in the Environmental Planning 13
and Assessment Act 1979. 14
gross floor area has the same meaning as in Liverpool Local 15
Environmental Plan 1997. 16
outlets centre means a building or place comprised of at least 20 17
separately leased retail outlets that is centrally managed and the 18
majority of outlets at which offer stock for sale a majority of which is 19
surplus, out of season, seconds or samples, but that does not include 20
retail outlets used for personal services (including hairdressers, barbers, 21
beauty parlours and the like), travel or real estate agencies, banks 22
(except automatic teller machines), insurance or financial institutions, 23
newsagencies, supermarkets, department stores, or for the retailing of 24
fresh food and groceries (other than cafes or other food outlets for 25
visitors to the centre where the food is to be immediately consumed). 26

4 Relationship with EP&A Act
For the purposes of the Environmental Planning and Assessment 28
Act 1979, section 3 is taken to be a provision of an environmental 29
planning instrument under that Act and prevails over any provision of 30
any other environmental planning instrument (made before or after the 31
date of assent to this Act) to the extent of any inconsistency. 32
