New South Wales Peak Oil Response Plan Bill 2008 No , 2008 A Bill for An Act to provide for the establishment of a Peak Oil Taskforce to inquire into and report on the best strategies to mitigate the impacts of peak oil.

 


 

Clause 1 Peak Oil Response Plan Bill 2008 Part 1 Preliminary The Legislature of New South Wales enacts: 1 Part 1 Preliminary 2 1 Name of Act 3 This Act is the Peak Oil Response Plan Act 2008. 4 2 Commencement 5 This Act commences on the date of assent to this Act. 6 3 Definitions 7 In this Act: 8 peak oil means the moment in time at which the maximum rate of global 9 petroleum production is reached. 10 Taskforce means the Peak Oil Taskforce established under section 4. 11 Page 2

 


 

Peak Oil Response Plan Bill 2008 Clause 4 Peak Oil Taskforce Part 2 Part 2 Peak Oil Taskforce 1 4 Establishment of Peak Oil Taskforce 2 (1) The Premier is to establish a Peak Oil Taskforce within one month after 3 the commencement of this Act. 4 (2) The Taskforce is to consist of not less than 5 persons appointed by the 5 Premier. 6 5 Functions of Taskforce 7 (1) The Taskforce is: 8 (a) to inquire into and assess the likely negative impacts of peak oil 9 on the State and people of New South Wales, and 10 (b) to report to the Premier on the best short, medium and long term 11 strategies to mitigate those impacts. 12 (2) The Taskforce may request the co-operation of any Department of the 13 Public Service in the carrying out of its functions and each such 14 Department must comply with any such request. 15 6 Public hearings and submissions 16 The Taskforce, in conducting its inquiry, is: 17 (a) to hold public meetings, and 18 (b) to invite submissions from the public and consider those 19 submissions. 20 7 Matters for consideration 21 Before preparing its report, the Taskforce is to consider (and, where 22 possible, quantify) the following: 23 (a) the oil based fuel requirements of the State and people of New 24 South Wales up to the year 2020 (differentiated by fuel types and 25 economic sectors), 26 (b) the impact of peak oil on the Australian motor vehicle industry 27 (including any anticipated changes to the importation of vehicles 28 and any resulting technological developments), 29 (c) the impact of peak oil on the economy and employment and 30 whether strategies for retraining and redeployment of employees 31 will be needed, 32 (d) the effect of peak oil on: 33 (i) critical local facilities in New South Wales (such as 34 hospitals, schools and emergency services), and 35 Page 3

 


 

Clause 8 Peak Oil Response Plan Bill 2008 Part 2 Peak Oil Taskforce (ii) the provision of food and water supplies to the people of 1 New South Wales, 2 (e) the effect of peak oil on disadvantaged, regional and rural 3 communities, 4 (f) any disruption to road transport (including disruption to freight 5 transport) caused by peak oil, 6 (g) the effect of peak oil on mining in New South Wales, 7 (h) whether alternative energy production and alternative fuels that 8 can be used in substitution for petroleum and other oil based 9 products can ameliorate the impacts of peak oil, 10 (i) the effect of peak oil on food affordability and availability, 11 (j) the need for public education, awareness and preparedness in 12 anticipation of peak oil, 13 (k) whether a system of fuel rationing will need to be established, 14 (l) whether new public transport infrastructure and other transport 15 infrastructure will be needed, 16 (m) the likelihood of sudden fuel emergencies (similar to the 1973 17 and 1979 oil crises), 18 (n) any other matter prescribed by the regulations. 19 8 Content of report 20 The report is to contain: 21 (a) a detailed risk management strategy to mitigate the short, 22 medium and long term impacts of peak oil, and 23 (b) strategies on how governments, business, community groups and 24 members of the public may achieve reductions in their use of 25 petroleum and other oil based fuels, and 26 (c) a list of priority uses of petroleum and other oil based fuels after 27 peak oil, and 28 (d) a strategy to deal with sudden fuel emergencies (similar to the 29 1973 and 1979 oil crises). 30 9 Timing of report 31 The report is to be completed and provided to the Premier within 32 12 months after the commencement of this Act. 33 10 Tabling of report 34 (1) The report is to be tabled by the Premier in each House of Parliament as 35 soon as practicable after it is received by the Premier. 36 Page 4

 


 

Peak Oil Response Plan Bill 2008 Clause 10 Peak Oil Taskforce Part 2 (2) If a House of Parliament is not sitting when the Premier seeks to table 1 the report, copies of the report are to be presented to the Clerk of the 2 House concerned by the Premier. 3 (3) The report: 4 (a) is, on presentation and for all purposes, taken to have been laid 5 before the House, and 6 (b) may be printed by authority of the Clerk of the House, and 7 (c) if so printed, is for all purposes taken to be a document published 8 by or under the authority of the House, and 9 (d) is to be recorded: 10 (i) in the case of the Legislative Council, in the Minutes of the 11 Proceedings of the Legislative Council, and 12 (ii) in the case of the Legislative Assembly, in the Votes and 13 Proceedings of the Legislative Assembly, 14 on the first sitting day of the House after receipt of the report by 15 the Clerk. 16 Page 5

 


 

Clause 11 Peak Oil Response Plan Bill 2008 Part 3 Miscellaneous Part 3 Miscellaneous 1 11 Regulations 2 The Governor may make regulations, not inconsistent with this Act, for 3 or with respect to any matter that by this Act is required or permitted to 4 be prescribed or that is necessary or convenient to be prescribed for 5 carrying out or giving effect to this Act. 6 Page 6
