A Bill for

An Act to amend the Police Integrity Commission Act 1996 to confer on the Police
Integrity Commission the same jurisdiction and powers as the Independent
Commission Against Corruption for the purposes of the continuation and completion
by the Police Integrity Commission of the investigation relating to Jeffrey Shaw.

 


 

Clause 1 Police Integrity Commission Amendment (Shaw Investigation) Bill 2005 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Police Integrity Commission Amendment (Shaw 3 Investigation) Act 2005. 4 2 Commencement 5 This Act commences on the date of assent. 6 3 Amendment of Police Integrity Commission Act 1996 No 28 7 The Police Integrity Commission Act 1996 is amended as set out in 8 Schedule 1. 9 Page 2

 


 

Police Integrity Commission Amendment (Shaw Investigation) Bill 2005 Amendment Schedule 1 Schedule 1 Amendment 1 (Section 3) 2 Section 131A 3 Insert after section 131: 4 131A Special arrangement for Shaw investigation 5 (1) The PIC may continue and complete the Shaw investigation and, 6 for that purpose, the PIC has, in addition to its own functions, the 7 functions of the ICAC. 8 (2) This section has effect despite any other provision of this Act or 9 the Independent Commission Against Corruption Act 1988 and 10 despite any decision of a court made before the commencement 11 of this section that relates to the PIC and the Shaw investigation 12 or any associated matter. 13 (3) For the purposes of this section: 14 complete an investigation includes issue a report on the 15 investigation. 16 continue an investigation includes recommence or reopen an 17 investigation. 18 Shaw investigation means the investigation concerning a 19 missing blood sample taken from Jeffrey Shaw, the former 20 Attorney General, following a car accident in October 2004. 21 Page 3
