Clause 1 Motor Dealers Amendment Bill 2007 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Motor Dealers Amendment Act 2007. 3 2 Commencement 4 This Act commences on a day or days to be appointed by proclamation. 5 3 Amendment of Motor Dealers Act 1974 No 52 6 The Motor Dealers Act 1974 is amended as set out in Schedule 1. 7 4 Repeal of Act 8 (1) This Act is repealed on the day following the day on which all of the 9 provisions of this Act have commenced. 10 (2) The repeal of this Act does not, because of the operation of section 30 11 of the Interpretation Act 1987, affect any amendment made by this Act. 12 Page 2
Motor Dealers Amendment Bill 2007 Amendments Schedule 1 Schedule 1 Amendments 1 (Section 3) 2 [1] Section 4 Definitions 3 Omit "but does not include" from the definition of second-hand motor vehicle 4 in section 4 (1). 5 Insert instead "and includes". 6 [2] Section 4 (7) 7 Omit "or a demonstrator motor vehicle". 8 [3] Section 21 Holder of licence to keep register 9 Omit "and every demonstrator motor vehicle" wherever occurring in section 10 21 (3) (a) and (5) (a). 11 [4] Section 24 Dealers' notices in respect of sale of second-hand motor 12 vehicles, second-hand motor cycles and damaged new motor vehicles 13 Insert "or demonstrator motor vehicle" after "second-hand motor cycle" 14 wherever occurring in section 24 (2), (3) and (4). 15 [5] Section 25 Sale of second-hand motor vehicle or demonstrator to trade 16 owner 17 Omit the section. 18 [6] Section 26 Defences 19 Omit "or 25". 20 [7] Section 26 (a) 21 Omit "either of those sections". Insert instead "that section". 22 [8] Section 29 Excluded defects 23 Omit "motor vehicle (being a second-hand motor cycle or demonstrator motor 24 vehicle)" from section 29 (3). 25 Insert instead "second-hand motor cycle". 26 [9] Section 29 (3) (b) 27 Omit "vehicle" wherever occurring.
