An Act to amend various Acts and instruments as a consequence of the proposed
enactment of the Local Court Act 2007.

The Legislature of New South Wales enacts: 1
1 Name of Act 2
This Act is the Miscellaneous Acts (Local Court) Amendment Act 2007. 3
2 Commencement 4
This Act commences on a day or days to be appointed by proclamation. 5
3 Amendment of Acts and instruments 6
The Acts and instruments specified in Schedule 1 are amended as set out 7
in that Schedule. 8
4 Further amendment of Acts and instruments 9
(1) Each Act and instrument specified in Column 1 of Schedule 2 is 10
amended by omitting "a Local Court" wherever occurring in the 11
provision of that Act or instrument specified in Column 2 of that 12
Schedule and inserting instead "the Local Court". 13
(2) Each Act and instrument specified in Column 1 of Schedule 3 is 14
amended by omitting "A Local Court" wherever occurring in the 15
provision of that Act or instrument specified in Column 2 of that 16
Schedule and inserting instead "The Local Court". 17
(3) Each Act and instrument specified in Column 1 of Schedule 4 is 18
amended by omitting "a Local Court constituted by a Magistrate sitting 19
alone" wherever occurring in the provision of that Act or instrument 20
specified in Column 2 of that Schedule and inserting instead "the Local 21
Court". 22
(4) Each Act and instrument specified in Column 1 of Schedule 5 is 23
amended by omitting "a Local Court constituted by a Magistrate" 24
wherever occurring in the provision of that Act or instrument specified 25
in Column 2 of that Schedule and inserting instead "the Local Court". 26

The Courts of Petty Sessions (Civil Claims) Further Amendment Act 3
1982 is repealed. 4
6 Repeal of Act 5
(1) This Act is repealed on the day following the day on which all of the 6
provisions of this Act have commenced. 7
(2) The repeal of this Act does not, because of the operation of section 30 8
of the Interpretation Act 1987, affect any amendment made by this Act. 9

(8) If default is made in the payment of any one or more of the 29
weekly or other periodical sums referred to in subsection (7), the 30
order for the payment of that sum or the total of those sums then 31
in default for any period not exceeding 6 months may be enforced 32
as if the order were an order for the payment of a sum of money 33
equal to that sum or the total of those sums made under the Civil 34
Procedure Act 2005 by the Local Court. 35
(9) Where an order under this Part contains a provision committing 36
to the applicant or any other person the legal custody of a minor, 37
a copy of the order may be served on any person in whose actual 38
custody the minor may for the time being be, and if such person 39
makes default in complying with such provision the person is 40
liable on summary conviction to a penalty not exceeding 0.1 41
