Government Schools (Infrastructure Register) Bill 2007 No , 2007 A Bill for An Act to establish a government schools infrastructure register and to provide for the preparation of school status reports and building plans; and for other purposes.
Clause 1 Government Schools (Infrastructure Register) Bill 2007 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Government Schools (Infrastructure Register) Act 2007. 3 2 Commencement 4 This Act commences on the date of assent. 5 3 Definitions 6 In this Act: 7 Department means the Department of Education and Training. 8 Director-General means the Director-General of the Department of 9 Education and Training. 10 financial year means a period of 12 months commencing on 1 July. 11 government school has the same meaning as in the Education Act 1990. 12 infrastructure includes demountables and buildings that are not 13 demountables. 14 4 Government schools infrastructure register to be kept 15 (1) The Director-General is to keep a register consisting of the following: 16 (a) each school status report submitted to the Minister under 17 section 5, 18 (b) each school building plan submitted to the Minister under 19 section 6. 20 (2) The register is to be kept in such form as the Director-General considers 21 appropriate. 22 (3) The register is to be made available for public inspection, free of charge, 23 on the website of the Department. 24 5 School status report 25 (1) The Director-General is to prepare and submit to the Minister a report 26 on the status of government school infrastructure (a school status 27 report) within the period of 4 months after the end of each financial 28 year. 29 (2) The report is to contain the following matters: 30 (a) particulars of the capital infrastructure of each government 31 school and of the state of repair of that infrastructure at the end of 32 the financial year to which the report relates, together with a 33 statement identifying how the existing state of repair of that 34 infrastructure was assessed, 35 Page 2
Government Schools (Infrastructure Register) Bill 2007 Clause 6 (b) an assessment of works of a capital nature that have been 1 identified by government schools or by the Department or any 2 other public authority, during the financial year to which the 3 report relates, as works that need to be carried out in government 4 schools, 5 (c) an assessment of the progress that has been made in carrying out 6 those works of a capital nature that are identified in the relevant 7 school building plan as capital works to be carried out during the 8 financial year to which the report relates, together with the 9 amount expended in carrying out each of those works during that 10 financial year, 11 (d) particulars of the amount expended on maintenance work for 12 each government school during the financial year to which the 13 report relates, 14 (e) particulars of the amount of any additional funding requested by 15 a government school for urgent maintenance during the financial 16 year to which the report relates and the amount of any additional 17 funding granted for that purpose, together with a statement of 18 reasons for any refusal to grant any such additional funding. 19 (3) A copy of the school status report is to be made available for public 20 inspection, free of charge, on the website of the Department. 21 6 School building plan 22 (1) The Director-General is to prepare and submit to the Minister a plan (a 23 school building plan), within the period of 4 months after the end of 24 each financial year, with respect to building and maintenance work in 25 government schools for the next 3 financial years (inclusive of the 26 financial year in which it is submitted). 27 (2) The school building plan is to contain the following matters: 28 (a) particulars of works of a capital nature that are to be carried out 29 in government schools during the period to which the plan 30 relates, the estimated time frame for completing the works and 31 the estimated cost (at current values) of carrying out the works, 32 (b) particulars of the money to be allocated, out of the money 33 appropriated by Parliament, to carrying out works of a capital 34 nature in government schools, together with the criteria by which 35 decisions are made about the allocation of that money and how 36 those criteria are applied, 37 Page 3
Clause 6 Government Schools (Infrastructure Register) Bill 2007 (c) particulars of the money to be allocated, out of the money 1 appropriated by Parliament, to carrying out maintenance work for 2 each government school, together with the criteria by which 3 decisions are made about the allocation of that money and how 4 those criteria are applied. 5 (3) A copy of the school building plan is to be made available for public 6 inspection, free of charge, on the website of the Department. 7 Page 4
