Government School Assets Register Bill 2003 No , 2003 A Bill for An Act to establish a register of government school assets and to provide for the preparation of school status reports and building plans; and for other purposes.
Clause 1 Government School Assets Register Bill 2003 1 The Legislature of New South Wales enacts: 2 1 Name of Act 3 This Act is the Government School Assets Register Act 2003. 4 2 Commencement 5 This Act commences on the date of assent. 6 3 Definitions 7 In this Act: 8 capital assets includes demountables and buildings that are not 9 demountables. 10 Department means the Department of Education and Training. 11 Director-General means the Director-General of the Department of 12 Education and Training. 13 financial year means a period of 12 months commencing on 1 July. 14 government school has the same meaning as in the Education Act 15 1990. 16 4 Register of government school assets to be kept 17 (1) The Director-General is to keep a register consisting of the 18 following: 19 (a) each school status report submitted to the Minister under 20 section 5, 21 (b) each school building plan submitted to the Minister under 22 section 6. 23 (2) The register is to be kept in such form as the Director-General 24 considers appropriate. 25 (3) The register is to be made available for public inspection, free of 26 charge, on the website of the Department. 27 5 School status report 28 (1) The Director-General is to prepare and submit to the Minister a 29 report on the status of government school assets (a school status 30 report) within the period of 4 months after the end of each financial 31 year. Government School Assets Register Bill 2003 Clause 6 1 (2) The report is to contain the following matters: 2 (a) particulars of the capital assets of each government school 3 and of the state of repair of those assets at the end of the 4 financial year to which the report relates, together with a 5 statement identifying how the existing state of repair of those 6 capital assets was assessed, 7 (b) an assessment of works of a capital nature that have been 8 identified by government schools or by the Department or any 9 other public authority, during the financial year to which the 10 report relates, as works that need to be carried out in 11 government schools, 12 (c) an assessment of the progress that has been made in carrying 13 out those works of a capital nature that are identified in the 14 relevant school building plan as capital works to be carried 15 out during the financial year to which the report relates, 16 together with the amount expended in carrying out each of 17 those works during that financial year, 18 (d) particulars of the amount expended on maintenance work for 19 each government school during the financial year to which the 20 report relates, 21 (e) particulars of the amount of any additional funding requested 22 by a government school for urgent maintenance during the 23 financial year to which the report relates and the amount of 24 any additional funding granted for that purpose, together with 25 a statement of reasons for any refusal to grant any such 26 additional funding. 27 (3) A copy of the school status report is to be included in the annual 28 report of the Department under the Annual Reports (Departments) 29 Act 1985. 30 6 School building plan 31 (1) The Director-General is to prepare and submit to the Minister a plan 32 (a school building plan), within the period of 4 months after the end 33 of each financial year, with respect to building and maintenance 34 work in government schools for the next 3 financial years (inclusive 35 of the financial year in which it is submitted). 36 (2) The school building plan is to contain the following matters: 37 (a) particulars of works of a capital nature that are to be carried 38 out in government schools during the period to which the plan 39 relates, the estimated time frame for completing the works 40 and the estimated cost (at current values) of carrying out the 41 works, Page 3
Clause 6 Government School Assets Register Bill 2003 1 (b) particulars of the money to be allocated, out of the money 2 appropriated by Parliament, to carrying out works of a capital 3 nature in government schools, together with the criteria by 4 which decisions are made about the allocation of that money 5 and how those criteria are applied, 6 (c) particulars of the money to be allocated, out of the money 7 appropriated by Parliament, to carrying out maintenance 8 work for each government school, together with the criteria 9 by which decisions are made about the allocation of that 10 money and how those criteria are applied. 11 (3) A copy of the school building plan is to be included in the annual 12 report of the Department under the Annual Reports (Departments) 13 Act 1985.
