Act No 35, 1999



An Act to amend the Electricity Supply Act 1995 with respect to the determination
of the price for the provision of electricity network services by a transmission
operator. [Assented to 7 July 1999]
 
 
Section 1       Electricity Supply Amendment Act 1999 No 35




The Legislature of New South Wales enacts:

   1     Name of Act
             This Act is the Electricity Supply Amendment Act 1999.

   2     Commencement
             This Act commences or is taken to have commenced on 1 July 1999.

   3     Amendment of Electricity Supply Act 1995 No 94
             The Electricity Supply Act 1995 is amended as set out in Schedule 1.

Schedule 1          Amendments

                                                                          (Section 3)

 [1]   Section 43M

       Omit the section. Insert instead:

       43M     Definitions
                    In this Division:
                    Code means the National Electricity Code, as in force from
                    time to time, referred to in the National Electricity (NSW) Law.
                    direct customer of a transmission operator has the same
                    meaning as in Division 1.
                    electricity network pricing determination means a
                    determination of the transmission network service pricing in
                    accordance with the Code for the provision of electricity
                    transmission network services by a transmission operator.
                    electricity transmission network services means transmission
                    network services regulated under Chapters 6 and 9 of the Code.

 [2]   Section 43N Pricing of electricity for direct customers

       Omit "maximum price for electricity network services" from section 43N
       (1).
       Insert instead "price for electricity transmission network services".

 [3]   Section 43N (1)

       Omit "IPART".

 [4]   Section 43N (2) and (3)

       Omit section 43N (2). Insert instead:
               (2) An electricity network pricing determination increased in
                   accordance with this section has effect under the Code as if the
                   determination included the increase.

                (3) An electricity network pricing determination that includes an
                    amount determined by an order made as referred to in
                    subsection (1) is not to be further increased in accordance with
                    this section.

 [5]     Dictionary

         Omit "transmission and" from the definition of electricity network services.
