An Act to amend the Summary Offences Act 1988, the Crimes (Administration of
Sentences) Act 1999 and the Crimes (Administration of Sentences) Regulation 2001
to prohibit inmates using mobile phones in places of detention.
I have examined this bill and find it to correspond in all respects with the bill as
finally passed by both Houses.

Clause 1 2007
The Legislature of New South Wales enacts:
1 Name of Act
This Act is the Crimes Legislation Amendment (Mobile Phones in
Places of Detention) Act 2007.
2 Commencement
This Act commences on the date of assent to this Act.
3 Amendment of Acts and Regulation
The Acts and Regulation specified in Schedule 1 are amended as set out
in that Schedule.
4 Repeal of Act
(1) This Act is repealed on the day following the day on which this Act
commences.
(2) The repeal of this Act does not, because of the operation of section 30
of the Interpretation Act 1987, affect any amendment made by this Act.

Schedule 1 Amendments
(Section 3)
1.1 Crimes (Administration of Sentences) Act 1999 No 93
Section 56A Penalty for use or possession of a mobile phone
Insert "use or" before "possession" in section 56A (1).
1.2 Crimes (Administration of Sentences) Regulation 2001
[1] Clause 113B Inmate use or possession of a mobile phone
Insert "use or" before "have in his or her possession".
[2] Schedule 2 Correctional centre offences
Omit "Possess mobile phone, mobile phone SIM card or mobile phone
charger" from the matter relating to clause 113B.
Insert instead "Use or possess mobile phone, mobile phone SIM card or
mobile phone charger".
1.3 Summary Offences Act 1988 No 25
Section 27DA Inmate use or possession of a mobile phone
Insert "use or" before "have in his or her possession" in section 27DA (1).
