An Act to amend the Constitution Act 1902 to restrict the prorogation of Parliament
before a general election.

The Legislature of New South Wales enacts: 1
1 Name of Act 2
This Act is the Constitution Amendment (Prorogation of Parliament) 3
Act 2011. 4
2 Commencement 5
This Act commences on the date of assent to this Act. 6
3 Amendment of Constitution Act 1902 No 32 7
(1) Section 10 Time and place for holding sessions of Parliament 8
Omit "He may also prorogue the Legislative Council and Assembly by 9
proclamation or otherwise whenever he deems it expedient.". 10
(2) Section 10A 11
Insert after section 10: 12
10A Prorogation of Parliament 13
(1) The Governor may, by proclamation, prorogue the 14
Legislative Council and Assembly whenever the Governor 15
considers it expedient to do so (subject to this section and 16
section 24B). 17
(2) The Premier or Executive Council may not advise the 18
Governor to prorogue the Legislative Council and 19
Assembly on a date that is before 26 January in the 20
calendar year in which the Legislative Assembly is due to 21
expire and that is after the fourth Saturday in the preceding 22
September. 23
