An Act to appropriate out of the Consolidated Fund sums for the recurrent services
and capital works and services of the Government for the year 200102.

Part 1 Preliminary
The Legislature of New South Wales enacts:
Part 1 Preliminary
1 Name of Act
This Act is the Appropriation Act 2001.
2 Commencement
This Act commences or is taken to have commenced on 1 July 2001.
3 Interpretation
In this Act, a reference to the year 200102 is a reference to the year
from 1 July 2001 to 30 June 2002.

4 General appropriation from Consolidated Fund 200102 for recurrent 1

(1) Out of the Consolidated Fund there are hereby appropriated the sums 3
identified in sections 6 to 24, inclusive, as the sums appropriated by 4
this Act for recurrent services, which sums may be issued and applied 5
for or towards the several uses and purposes expressed in those 6
sections for the recurrent services of the Government for the year 7
200102. 8
(2) The total sum appropriated out of the Consolidated Fund for the 9
recurrent services of the Government for the year 200102, in 10
accordance with the provisions of sections 6 to 24, inclusive, is the 11
sum of $25,159,621,000. 12
(3) Any amounts expended for recurrent services under section 25 of the 13
Public Finance and Audit Act 1983 or any Supply Act on or after 14
1 July 2001 and before the date of assent to this Act are taken to have 15
been expended out of such of the sums for recurrent services set out 16
in sections 6 to 24, inclusive, as may be determined by the Treasurer. 17
5 General appropriation from Consolidated Fund 200102 for capital 18
works and services 19
(1) Out of the Consolidated Fund there are hereby appropriated the sums 20
identified in sections 6 to 24, inclusive, as the sums appropriated by 21
this Act for capital works and services, which sums may be issued and 22
applied for or towards the several uses and purposes expressed in those 23
sections for capital works and services for the year 200102. 24
(2) The total sum appropriated out of the Consolidated Fund for capital 25
works and services for the year 200102, in accordance with the 26
provisions of sections 6 to 24, inclusive, is the sum of $3,791,264,000. 27
(3) Any amounts expended for capital works and services under section 25 28
of the Public Finance and Audit Act 1983 or any Supply Act on or 29
after 1 July 2001 and before the date of assent to this Act are taken to 30
have been expended out of such of the sums for capital works and 31
services set out in sections 6 to 24, inclusive, as may be determined by 32
the Treasurer. 33

25 Variation of authorised payments from Consolidated Fund 2
(1) Payment of a sum appropriated under Part 2 may not be made by an 3
agency in excess of the sum specified in relation to the agency, except 4
as provided by this section and Division 4 of Part 2 of the Public 5
Finance and Audit Act 1983. 6
(2) If the exigencies of the Public Service render it necessary, the 7
Treasurer may authorise: 8
(a) the payment of a sum in excess of the amount shown as the 9
Consolidated Fund Recurrent Services estimate for an agency, 10
but only on the condition that an equivalent sum is not paid out 11
of the estimate of the Consolidated Fund Recurrent Services for 12
another agency, and 13
(b) the payment of a sum in excess of the amount shown as the 14
Consolidated Fund Capital Works and Services estimate for an 15
agency, but only on the condition that an equivalent sum is not 16
paid out of the estimate of the Consolidated Fund Capital 17
Works and Services for another agency. 18
(3) This section does not apply to sums appropriated otherwise than by 19
this Act. 20
(4) This section does not empower the Treasurer to authorise the payment 21
of a sum in augmentation of or as an addition to any salary or wages 22
the amount of which has been fixed by law. 23
(5) The Treasurer, or a person appointed by the Treasurer under 24
section 26, is required to inform the Auditor-General of every 25
authorisation given under this section. 26

26 Appointment of person to carry out the functions of the Treasurer 1

(1) The Treasurer may appoint a person to carry out the Treasurer's 3
functions under section 25. 4
(2) Any such appointment is subject to such conditions (if any) as the 5
Treasurer determines. 6
(3) The Treasurer may revoke any such appointment at any time. 7
