WORKPLACE RELATIONS ACT 1996 - SECT 365 Seeking to include prohibited content in an agreement

This legislation has been repealed.

WORKPLACE RELATIONS ACT 1996 - SECT 365

             (1)  A person contravenes this subsection if:

                     (a)  the person seeks to include a term:

                              (i)  in a workplace agreement in the course of negotiations for the agreement; or

                             (ii)  in a variation to a workplace agreement in the course of negotiations for the variation; and

                     (b)  that term contains prohibited content; and

                     (c)  the person is reckless as to whether the term contains prohibited content.

             (2)  Subsection (1) is a civil remedy provision.
