1. Amendment


  1.1 The Trade Practices Regulations are amended as set out in these 
Regulations.

  2.1 After regulation 6I, insert:
Access Codes prepared by industry bodies (Act, section 44ZZAA) 
  "6J. (1) For the purposes of paragraph 44ZZAA (3) (e) of the Act, 
the following matters are, where relevant, matters which the 
Commission must have regard in considering whether to accept an access 
code:
  (a) government legislation and policies relating to ecologically 
sustainable development; and
  (b) social welfare and equity considerations, including community 
service obligations; and
  (c) government legislation and policies relating to matters such as 
occupational health and safety, industrial relations and access and 
equity: and 
  (d) economic and regional development, including employment and 
investment growth; and
  (e) the interests of consumers generally or of a class of consumers; 
and
  (f) the competitiveness of Australian businesses; and
  (g) the efficient allocation of resources.
  "(2) For the purposes of subsection 44ZZAA (8) of the Act, the 
National Electricity Code Administrator Limited ('NECA'), Australian 
Company Number 073 942 775, is a prescribed industry body.".
