Amendment 1.1 The Radiocommunications Regulations are amended as set out in these Regulations. [NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.] RADIOCOMMUNICATIONS REGULATIONS (AMENDMENT) 1997 No. 121 - REG 2 2. Regulation 3 (Interpretation) 2.1 Definition of "aeronautical frequencies": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.2 Definition of "aeronautical mobile-satellite frequencies": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.3 Definition of "aircraft station": Omit paragraph (b), substitute: "(b) is operated on aeronautical frequencies; and". 2.4 Definition of "amateur frequencies": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.5 Definition of "amateur intermediate station": Omit paragraph (a), substitute: "(a) to whom: (i) a certificate of proficiency has been granted in relation to the Limited Amateur Operator's Examination, which is a category of approved examination for the purposes of subsection 122 (2) of the Act; and (ii) a certificate of proficiency has been granted in relation to the Novice Amateur Operator's Examination, which is a category of approved examination for the purposes of subsection 122 (2) of the Act; or". 2.6 Definition of "amateur limited station": Paragraph (a): Omit "referred to in regulation 16; or", substitute ", which is a category of approved examination for the purposes of subsection 122 (2) of the Act; or". 2.7 Definition of "amateur novice limited station": Paragraph (a): Omit "referred to in regulation 17A; or", substitute ", which is a category of approved examination for the purposes of subsection 122 (2) of the Act; or". 2.8 Definition of "amateur novice station": Paragraph (a): Omit "referred to in regulation 17; or", substitute ", which is a category of approved examination for the purposes of subsection 122 (2) of the Act; or". 2.9 Definition of "amateur station": Omit paragraph (b), substitute: "(b) is operated on amateur frequencies or frequency bands; and". 2.10 Definition of "amateur unrestricted station": Paragraph (a): Omit "referred to in regulation 15; or", substitute ", which is a category of approved examination for the purposes of subsection 122 (2) of the Act; or". 2.11 Definition of "AUSSAT Service": Omit the definition. 2.12 After the definition of "authorised person", insert: " 'carriage service' means a service for carrying communications by means of: (a) guided electromagnetic energy; or (b) unguided electromagnetic energy; or (c) guided and unguided electromagnetic energy;". 2.13 Definition of "earth receive station": Paragraph (d): After "SMA", insert ", or a person accredited under section 263 of the Act,". 2.14 Definition of "emergency position indicating radio beacon station": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.15 Definition of "fixed receive station": Paragraph (c): After "SMA", insert ", or a person accredited under section 263 of the Act,". 2.16 Definition of "land mobile frequency": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.17 After the definition of "land station", insert: " 'licence conditions determination', in relation to a licence, means licence conditions as determined by the SMA under paragraph 107 (1) (f) of the Act;". 2.18 Definition of "limited coast marine rescue station": Paragraph (g): Omit the paragraph, substitute: "(g) may operate on maritime frequencies;". 2.19 Definition of "major coast receive station": Omit the definition, substitute: " 'major coast receive station' means a station: (a) that is used on land principally for receiving messages transmitted by maritime ship stations; and (b) that is not capable of transmitting messages of any kind; and (c) that may be used for receiving messages transmitted by: (i) aircraft stations; and (ii) land mobile stations; and (iii) outpost stations; and (d) for which the SMA, or a person accredited under section 263 of the Act, undertakes coordination procedures for the purpose of minimising interference to reception;". 2.20 Definition of "maritime coast station": Paragraph (a): After "operated", insert "on land". 2.21 Definition of "maritime coast station": Paragraph (b): Omit "if permitted by the transmitter licence that relates to the station - ", substitute "that". 2.22 Definition of "maritime frequencies": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.23 Definition of "maritime ship station": Omit paragraph (d), substitute: "(d) operates on maritime frequencies; and". 2.24 Definition of "outpost station": Omit the definition, substitute: " 'outpost station' means a station operating in the HF frequency band that is primarily established: (a) for the purposes of participation in an education program provided by a school of the air; or (b) to provide radiocommunications in a remote locality at which a connection to a carriage service is not provided; or (c) where a connection to a carriage service supplied to the public is provided at the remote locality where the station is situated - to provide radiocommunications in the locality for the purposes of an emergency that involves: (i) prejudice to the security or defence of Australia; or (ii) a serious threat to the environment; or (iii) risk of injury to, or death of, a person; or (iv) risk of damage to, or substantial loss of, property; [NOTE: The HF frequency band is broadly defined as 3 MHz to 30 MHz: see Volume 1 of the International Telecommunication Union Radio Regulations published by the ITU and as in force from time to time.]". 2.25 Definition of "Radiocommunications Australian Spectrum Plan": Omit the definition. 2.26 Definition of "radiodetermination frequencies": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". 2.27 Definition of "ship station Class A": Paragraph (a): Omit "and; and", substitute "and" 2.28 After the definition of "Spectrum Manager", insert: " 'spectrum plan' means the spectrum plan in force from time to time under the Act;". 2.29 Definition of "survival craft station": Omit "Radiocommunications - Australian Spectrum Plan", substitute "spectrum plan". RADIOCOMMUNICATIONS REGULATIONS (AMENDMENT) 1997 No. 121 - REG 3 3. Regulation 4 (What is an Australian Satellite?) 3.1 Omit the regulation, substitute: Australian satellites "4. (1) For the purposes of the definition of 'Australian satellite' in section 5 of the Act, the following satellites are declared to be Australian satellites: (a) space satellites operated by Optus Networks Pty Limited ACN 008 570 330 to provide communications services to Australia; (b) space satellites operated by Iridium LLC to provide mobile satellite services to Australia. "(2) In subregulation (1): 'mobile satellite services' has the meaning it has in the spectrum plan.
