These Regulations may be cited as the National Gallery Regulations. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 2 Interpretation 2. In these Regulations, unless the contrary intention appears- "authority" means an authority given under regulation 9; "certificate" means a certificate issued under sub-regulation 5 (2); "Gallery building" means the building, erected on Gallery land, in which works of art are displayed; "Gallery land" means the land (being Blocks 5 and 6, Section 29, Division of Parkes in the Australian Capital Territory) the boundaries of which are delineated in Deposited Plan 5838 held in the office of the Registrar of Titles at Canberra in the Australian Capital Territory; "liquor" has the same meaning as in section 45 of the Act; "security officer" means a person appointed under regulation 5 to be a security officer; "work of art" means- (a) a work forming part of the national collection; or (b) any other work under the control of the Gallery; "the Act" means the National Gallery Act 1975. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 3 Prescribed amounts for the purposes of section 38 of the Act 3. (1) For the purposes of paragraph 38 (a) of the Act, the amount of $450,000 is prescribed. (2) For the purposes of paragraphs 38 (b) and (d) of the Act, the amount of $100,000 is prescribed. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 4 Entry charge 4. (1) Subject to sub-regulation (3), a charge of $2 is fixed for entry into the Gallery building during opening hours by a person other than a prescribed person. (2) For the purposes of sub-regulation (1), each of the following is a prescribed person: (a) a child under the age of 15 years; (b) a person who is a full-time student at a school, college or university; (c) a person who is in receipt of- (i) a pension payable under Part III or Part IV, a benefit payable under Part IVAAA or Part VII, or an allowance payable under Part VIIA, of the Social Security Act 1947; or (ii) a pension or allowance payable under Part III of the Repatriation Act 1920; (d) a dependant of a person referred to in paragraph (c); (e) a person who is a member of the Australian National Gallery Association. (3) The Council may, from time to time, determine that no charge is payable under sub-regulation (1) during such period as the Council specifies. (4) In sub-regulation (1), "opening hours", means the hours determined by the Council as the hours during which the Gallery is to be open to the public. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 5 Security officers 5. (1) The Council may, by instrument in writing, appoint a person employed by the Gallery under section 33 of the Act to be a security officer. (2) The Council shall cause to be issued to each person appointed to be a security officer a certificate, in accordance with the form set out in the Schedule, containing a photograph of the person. (3) A person who ceases to be a security officer shall forthwith return his certificate to the Council. (4) A security officer shall, when exercising his powers under these Regulations in relation to a person, at the request of the person produce his certificate for inspection by the person. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 6 Powers of security officer 6. (1) Where a security officer has reasonable grounds for believing that- (a) a work of art has been, or may be, damaged by a person; or (b) a person has refused to obey a direction of a security officer given under sub-regulation (3), the security officer may, using such force as is reasonably necessary, apprehend the person. (2) A person who has been apprehended in accordance with sub-regulation (1) may be- (a) removed from the Gallery building, or the Gallery land, or both; or (b) held in the custody of a security officer until the person can be delivered to a member of the Australian Federal Police. (3) Where a security officer has reasonable grounds for believing that- (a) public safety is or may be endangered by the continued presence of a person, or a group of persons, in the Gallery building or on Gallery land or, for any other reason, the safety of members of the public who are present in the Gallery building or on Gallery land is endangered; (b) the conduct of a person or of a group of persons is likely to cause offence to members of the public or to the staff; or (c) a person has committed, or is about to commit, an offence against these Regulations, the security officer may direct the person or persons, or the members of the public, as the case requires, to leave the Gallery building or the Gallery land, or both. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 7 Offences 7. (1) A person shall not, in the Gallery building or on Gallery land- (a) touch, interfere with or damage a work of art; (b) refuse to obey a direction of a security officer given in the exercise of his powers under these Regulations; (c) without the consent in writing of the Council, expose or cause to be exposed for show, sale or hire any article for use or consumption by a member of the public; (d) fail to obey a notice displayed in the Gallery building or on Gallery land, being a notice issued by the authority of the Council and bearing a statement to that effect; or (e) where the person is carrying a prescribed article-fail to deposit the prescribed article at the counter in the Gallery building made available by the Council for the purpose. Penalty: $100. (2) A person shall not- (a) cause or permit an animal belonging to the person or in his charge to enter or remain in the Gallery building; (b) affix any article to, or write upon or deface in any way, the Gallery building or any wall or fence on Gallery land; (c) bring any liquid or food into the Gallery building; (d) consume any food or potable liquid within the Gallery building other than in an area set aside by the Council for that purpose; (e) smoke in an area of the Gallery building other than an area in which smoking is permitted; or (f) without the consent of the Council or a person authorized by the Council to give consents for the purposes of this paragraph, enter, or remain in, an area of the Gallery building or of Gallery land to which a notice declaring that that area is not open to the public relates. Penalty: $100. (3) Paragraph (2) (a) does not apply to or in relation to the taking by a blind person of his guide dog into the Gallery building. (4) Paragraph (2) (c) does not apply to or in relation to the bringing by a person of medication in liquid form into the Gallery building. (5) In paragraph (1) (e), "prescribed article" means- (a) an overcoat, a bag (other than a handbag), case, parcel or other container; (b) an umbrella, and aerosol container or any other article that is capable of being used to cause damage to a work of art; and (c) a camera or associated equipment. (6) A notice displayed for the purposes of paragraph (1) (f) shall- (a) be issued by the authority of the Council and bear a statement to that effect; and (b) be clearly displayed at the entrance to the area of the Gallery building or Gallery land to which it relates. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 8 Motor vehicles 8. (1) A security officer may direct the person apparently in charge of a motor vehicle that is on Gallery land or within a parking area established within the Gallery building- (a) not to park the vehicle on gallery land or within the parking area except in a specified place; (b) not to park the vehicle in a specified place; or (c) not to park the vehicle on Gallery land or within the parking area. (2) A person to whom a direction under sub-regulation (1) is given shall not, without reasonable excuse, fail to comply with the direction. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 9 Council may authorize sale of liquor 9. (1) The Council may, by instrument in writing, authorize the sale of liquor in the Gallery building. (2) An instrument under sub-regulation (1) shall specify- (a) the name of the person by whom liquor may be sold; (b) the part or parts of the Gallery building in which liquor may be sold; and (c) the hours during which liquor may be sold. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 10 Sale of liquor 10. (1) A person other than the holder of an authority shall not sell or supply liquor to a person in the Gallery building. (2) The holder of an authority shall not sell or supply liquor otherwise than in accordance with the terms of the authority. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 11 Liquor not to be sold or supplied to intoxicated persons, &c. 11. The holder of an authority shall not sell or supply liquor to a person in respect of whom there are reasonable grounds for believing that he is intoxicated or suffering the effects of mental illness. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 12 Sale of liquor to young persons 12. (1) The holder of an authority shall not sell or supply liquor to a person under the age of 18 years. Penalty: $100. (2) Sub-regulation (1) does not apply where- (a) the person to whom liquor was sold or supplied, as the case may be, was not less than 16 years of age; and (b) the holder of the authority had reasonable grounds for believing that the person was not less than 18 years of age. (3) The holder of an authority or an employee of the holder of an authority may refuse to sell liquor to a person unless that person satisfies the holder of the authority or the employee, as the case may be, of his age. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 13 Consumption of liquor by young persons 13. A person under the age of 18 years shall not- (a) purchase or consume liquor in that part of the Gallery building to which an authority relates; or (b) purchase liquor from the holder of an authority. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 14 Young person not to be sent to obtain liquor 14. A person shall not send a person under the age of 18 years to purchase or collect liquor in or from that part of the Gallery building to which the authority relates. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 15 Persons under 18 years not to enter certain parts of Gallery building 15. A person who has not attained the age of 18 years shall not enter that part of the Gallery building to which an authority relates except in the care of a responsible adult. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 16 Holder of an authority not to sell adulterated liquor 16. The holder of an authority shall not sell, offer for sale or expose for sale adulterated liquor. Penalty: $100. 1982 No. 259 NATIONAL GALLERY REGULATIONS - REG 17 Delegation 17. (1) The Council may, by resolution, either generally or as otherwise provided by the resolution, delegate to a person its powers under these Regulations. (2) A power so delegated, when exercised by the delegate shall, for the purposes of these Regulations, be deemed to have been exercised by the Council. (3) A delegation under this regulation- (a) may be revoked by resolution of the Council (whether or not constituted by the persons constituting the Council at the time the power was delegated); (b) does not prevent the exercise of the power by the Council; and (c) continues in force notwithstanding a change in the membership of the Council. (4) A certificate signed by the Chairman stating any matter with respect to a delegation of a power under this regulation is evidence of that matter.
