1993 No. 47 INCOME TAX REGULATIONS (AMENDMENT) - REG 2

2. New regulation 137A
2.1 After regulation 137, insert: Deductions from royalties

"137A. (1) The amount of the deduction to be made from a royalty under section
221YL is:

   (a)  if the person to whom the royalty is paid is a resident of a country
        with which Australia does not have a double tax agreement-30% of the
        royalty; and

   (b)  if the person to whom the royalty is paid is a resident of a country
        with which Australia has a double tax agreement-the amount calculated
        at the rate provided for in that agreement.

"(2) In this regulation, a 'double tax agreement' means an agreement within
the meaning of the Income Tax (International Agreements) Act 1953.".
