Travelling allowance-day trip 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 1 Citation 1. These Regulations may be cited as the Industrial Relations (Allowances) Regulations. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 2 Commencement 2. These Regulations are taken to have commenced on 1 February 1996. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 3 Interpretation 3. In these Regulations, unless the contrary intention appears: "Act" means the Industrial Relations Act 1988. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 4 Prescribed allowances-members of the Commission 4. For the purposes of paragraphs 21 (1) (b), 21 (2) (b), 21 (2A) (b), 21 (2B) (b) and 23 (1) (b) of the Act, the allowances specified in these Regulations are prescribed in relation to Presidential Members and Commissioners. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 5 Travelling allowance-overnight stay 5. (1) If a member of the Commission is necessarily absent overnight from the member's ordinary place of residence in the course of the performance of the member's duties, then, subject to subregulations (2) and (3), a travelling allowance is payable to the member in respect of each overnight stay at the following rates: (a) in the case of a Presidential Member: (i) for each overnight stay in a capital city-$320; and (ii) for each overnight stay in any other place-$165; and (b) in the case of a Commissioner: (i) for each overnight stay in Sydney-$245; and (ii) for each overnight stay in a capital city other than Sydney-$200; and (iii) for each overnight stay in any other place-$155. (2) If the cost of accommodation or meals is met directly by the Commonwealth, travelling allowance is payable to a member for each overnight stay, as follows: (a) if the cost of accommodation only is met-$80; and (b) if the cost of accommodation and 1 meal each day are met-$65; and (c) if the cost of accommodation and each meal each day is met-$50. (3) If a single period of absence by a member includes 1 or more periods of 24 hours and a further period of not less than 10 hours, a further amount of $50 is payable to the member in respect of that period of absence. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 6 Travelling allowance-spouses 6. If the spouse of a member of the Commission accompanies the member on an overnight stay, there is payable to the member in respect of each overnight stay, an additional allowance equal to: (a) the vouched additional costs of hiring a double room instead of a single room; or (b) if those costs are not vouched, the amount of $10. 1996 No. 33 INDUSTRIAL RELATIONS (ALLOWANCES) REGULATIONS - REG 7 Travelling allowance-day trip 7.
