1989 No. 12 INDUSTRIAL RELATIONS REGULATIONS - REG 119

No action for defamation in certain cases
119. No action or proceeding, civil or criminal, for defamation lies:

   (a)  against:

        (i)    the Commonwealth or an electoral official in respect of the
               printing or issuing of material by the electoral official in
               the course of conducting, on behalf of the Australian Electoral
               Commission, an election under the Act, being material prepared
               by or on behalf of a candidate in the election; or

        (ii)   the Commonwealth or an electoral official in respect of the
               printing or issuing of a document or other material by the
               electoral official who is conducting, on behalf of the
               Australian Electoral Commission, a ballot under the Act, being
               a document or other material that is required or permitted
               under paragraph 85 (b) or (c) to be contained in the sealed
               envelope referred to in regulation 85; or

   (b)  where the electoral official causes the material or document referred
        to in subparagraph (a) (i) or (ii) to be printed-against the person
        who printed that material or document, as the case may be, in respect
        of that printing.
