FAMILY LAW (SUPERANNUATION) REGULATIONS 2001 2001 No. 303 - REG 72

Notice to trustee by non-member spouse

(1) The non-member spouse in relation to a superannuation interest that is subject to a payment split must notify the trustee of the eligible superannuation plan in which the interest is held of the following matters:

(a)
the non-member spouse's full name;

(b)
the non-member spouse's postal address;

(c)
the non-member spouse's date of birth;

(d)
whether the non-member spouse is a member of the plan and, if so, the non-member spouse's membership number, if known.

(2)
The notice must:

(a)
be in writing; and

(b)
be signed by the non-member spouse; and

(c)
state the date when it is given.

(3)
The non-member spouse must give the notice to the trustee as soon as practicable after the copy of the relevant superannuation agreement or flag lifting agreement is served on the trustee, or the splitting order is made.
