Commencement 1.1 Regulation 3 is taken to have commenced on 1 July 1992. 1.2 Regulations 4 and 5 are taken to have commenced on 1 July 1990. (NOTE: The remainder of these Regulations commence on gazettal: see Acts Interpretation Act 1901 s. 48) 1993 No. 44 EXPORT MARKET DEVELOPMENT GRANTS REGULATIONS (AMENDMENT) - REG 2 2. Amendment 2.1 The Export Market Development Grants Regulations are amended as set out in these Regulations. 1993 No. 44 EXPORT MARKET DEVELOPMENT GRANTS REGULATIONS (AMENDMENT) - REG 3 3. New regulations 4, 4A, 4B, 4C and 4D 3.1 After regulation 3, insert: Specification of particular kinds of goods "4. Each of the following kinds of eligible goods is specified as a particular kind of goods for the purposes of section 15 of the Act: (a) goods of the kind mentioned in paragraph 5 (1) (a) of the Act; (b) goods of the kind mentioned in paragraph 5 (1) (b) of the Act. Specification of particular kinds of know-how "4A. Each of the following kinds of eligible know-how is specified as a particular kind of know-how for the purposes of section 15 of the Act: (a) know-how in relation to eligible goods; (b) know-how in relation to services of the following kinds: (i) eligible external governmental educational services; (ii) eligible internal educational services; (iii) eligible internal services; (iv) eligible services; (v) eligible tourism services. Specification of particular kinds of property rights "4B. Each of the following kinds of eligible industrial property rights is specified as a particular kind of property rights for the purposes of section 15 of the Act: (a) rights of the kind mentioned in paragraph (a) of the definition of 'eligible industrial property rights' in subsection 3 (1) of the Act; (b) rights of the kind mentioned in paragraph (b) of that definition. Specification of particular kinds of services "4C. Each of the following kinds of services is specified as a particular kind of services for the purposes of section 15 of the Act: (a) in respect of eligible external governmental educational services: (i) services of the kind mentioned in paragraph (a) of Schedule 5A; (ii) services of the kinds mentioned in paragraphs (b) to (e) (inclusive) of Schedule 5A; (b) in respect of eligible internal educational services: (i) services of the kind mentioned in paragraph (a) of Schedule 5; (ii) services of the kinds mentioned in paragraphs (b) and (c) of Schedule 5; (c) in respect of eligible internal services: (i) services of the kind mentioned in clause 1 of Schedule 1; (ii) services of the kind mentioned in clause 2 of Schedule 1; (d) in respect of eligible services: (i) technical services (other than technical services within the meaning of section 15 of the Act) of the kinds mentioned in clauses 1 and 2 of Schedule 4; (ii) services of the following kinds: (A) advisory services of the kinds mentioned in clauses 1 and 2 of Schedule 4; (B) services (other than technical services within the meaning of section 15 of the Act) of the kinds mentioned in clauses 3 to 14 (inclusive) of Schedule 4. Specification of particular kinds of technical services "4D. (1) Each of the following kinds of technical services is specified as a particular kind of technical services for the purposes of section 15 of the Act: (a) technical services undertaken outside Australia in relation to physical on-site work in any of the following fields: (i) construction; (ii) engineering; (iii) mining; and (b) technical services undertaken outside Australia in relation to physical on-site work in the field of protection of the environment.". 1993 No. 44 EXPORT MARKET DEVELOPMENT GRANTS REGULATIONS (AMENDMENT) - REG 4 4.
