Pay of members other than officers and trainees


  1. Regulation 8 of the Defence Force (Reserves) (Financial) Regulations is
amended-
  (a)  by inserting in sub-paragraph (1) (b) (iii) "or is deemed to have
completed under sub-regulation (2)" after "completed";
  (b)  by omitting sub-regulation (1A) and substituting the following
sub-regulation:
     "(1A) In this regulation, a reference to service that a member has
completed in a rank is, in relation to a member other than a member referred
to in sub-regulation (2) or 12 (5), a reference to the service actually
completed by the member in that rank and, in the case of a member who has been
downgraded, reduced or reverted to a rank specified in Part I of Schedule 5,
shall include any period or periods of service in that rank prior to promotion
from that rank to a higher rank."; and
  (c)  by omitting sub-regulation (2) and substituting the following
sub-regulation:
     "(2) A member of the Army-
     (a)  who holds the rank of Private;
     (b)  who-
         (i)  held that rank on or before 1 July 1975; or
        (ii)  has completed, after 1 July 1975, training for his category of
employment or prospective employment;
     (c)  who has, after 1 July 1975 or the date of the completion of that
training as the case requires, completed not less than 2 years of training;
and
     (d)  who is proficient in his military trade or skill,
    shall, for the purposes of this regulation, be deemed to be a member who
holds the rank of Lance Corporal and any service rendered by that member while
he continues to fulfil the conditions specified in paragraphs (a), (b), (c)
and (d) shall, for the purposes of this regulation, be deemed to be service in
the rank of Lance Corporal.".

Application


  2. This Interim Determination shall be deemed to have come into operation on
5 November 1981.
