1980 No. 332 CENSUS REGULATIONS (AMENDMENTS) - REG 3

3. The Census Regulations are amended by adding at the end thereof the
following regulations and Schedule: Division of Australia for the Census

"5. The Statistician shall, for the purpose of the taking and collection of
the Census-

   (a)  divide each State into Census Divisions;

   (b)  divide each Census Division into Census Sub-divisions; and

   (c)  divide each Census Sub-division into Collection Districts.

Appointment of officers

"6. (1) For the purpose of the taking and collection of the Census, the
Statistician-

   (a)  shall appoint-

        (i)    a person to be the Australian Field Supervisor;

        (ii)   a person to be the Chief Field Co-ordinator for Australia;

        (iii)  in respect of each State, a person to be the State Field
               Supervisor for the State; and

        (iv)   in respect of each Census Division, a person to be the
               Divisional Field Supervisor for the Division; and

   (b)  may appoint-

        (i)    a person to be the Assistant State Field Supervisor for a
               State;

        (ii)   a person to be the Clerk to the Divisional Field Supervisor for
               a Census Division; and

        (iii)  a person to be the Census Field Officer for a Census Division.



"(2) For the purpose of the taking and collection of the Census, a State Field
Supervisor for a State may-

   (a)  appoint a person to be the Collector for a specified dwelling, train,
        motor coach or aircraft; and

   (b)  appoint persons as clerical assistants to Divisional Field Supervisors
        for Census Divisions in the State.



"(3) For the purpose of the taking and collection of the Census, a Divisional
Field Supervisor for a Census Division-

   (a)  shall appoint, in respect of each Census Sub-division in that
        Division, a person to be the Group Leader for the Sub-division;

   (b)  shall appoint, in respect of each Collection District in that
        Division, a person to be the Collector, or persons to be Collectors,
        for the District;

   (c)  may appoint a person to be the Collector for a specified dwelling in
        that Division; and

   (d)  may appoint persons as assistants or interpreters to assist persons
        appointed under paragraph (a), (b) or (c).



"(4) A person may be appointed under this regulation to be-

   (a)  the Group Leader for more than one Census Sub-division;

   (b)  the Collector or a Collector for more than one Collection District; or

   (c)  the Collector for more than one specified dwelling, train, motor coach
        or aircraft.

Duties of Australian Field Supervisor

"7. The Australian Field Supervisor shall-

   (a)  furnish advice to the Statistician on such matters relating to the
        taking and collection of the Census as the Statistician requires;

   (b)  take all necessary action to ensure that sufficient persons are
        available for appointment as officers for the purpose of the taking
        and collection of the Census;

   (c)  ensure that all instructions of the Statistician relating to the
        taking and collection of the Census are communicated to officers in
        sufficient time before the Census day to allow those instructions to
        be carried out effectively;

   (d)  ensure that sufficient supplies of all documents and books necessary
        for the taking of the Census are furnished to officers before the
        Census day;

   (e)  arrange for the payment to officers of the remuneration (if any)
        payable to them in respect of their duties under the Act or these
        Regulations; and

   (f)  carry out such other duties in relation to the taking or collection of
        the Census as the Statistician directs.

Duties of Chief Field Co-ordinator

"8. The Chief Field Co-ordinator for Australia shall assist the Australian
Field Supervisor in the performance of the duties referred to in regulation 7.

Duties of State Field Supervisors and Assistant State Field Supervisors

"9. (1) A State Field Supervisor for a State shall-

   (a)  make all necessary arrangements for the distribution and collection of
        Householder's Schedules and personal forms in the State;

   (b)  cause the Householder's Schedules and personal forms collected in the
        State to be forwarded to the Statistician as soon as practicable after
        their collection has been completed;

   (c)  forward such summaries and reports relating to those Schedules or
        forms as the Statistician requires; and

   (d)  carry out such other duties in relation to the taking or collection of
        the Census as the Statistician directs.



"(2) An Assistant State Field Supervisor for a State shall assist the State
Field Supervisor for the State in the performance of the duties referred to in
sub-regulation (1) and, during any illness or absence of that State Field
Supervisor, shall perform those duties.

Duties of Divisional Field Supervisors, &c.



"10. (1) A Divisional Field Supervisor, Census Field Officer, Group Leader or
Collector shall carry out such duties in relation to the taking and collection
of the Census as the Statistician directs and, in the case of a Collector, as
are prescribed by the Act or these Regulations.



"(2) The Clerk to the Divisional Field Supervisor for a Census Division shall
assist that Divisional Field Supervisor, as directed by that Divisional Field
Supervisor, in the performance of the duties of that Divisional Field
Supervisor.

Specific instructions to Collectors

"11. Where 2 or more persons are appointed under sub-regulation 6 (3) to be
Collectors for a Collection District, the Divisional Field Supervisor for the
Census Division, or the Group Leader for the Census Sub-division, in which the
Collection District is included shall give instructions to each person so
appointed concerning the part or parts of the Collection District in respect
of which that person shall perform his duties as Collector.

Distribution of Householder's Schedules

"12. (1) Subject to sub-regulation (3), a Collector for a Collection District
shall, on or before the Census day, leave a Householder's Schedule-

   (a)  if paragraph (b) does not apply-at each dwelling within that
        Collection District; or

   (b)  if 2 or more persons have been appointed under sub-regulation 6 (3) to
        be Collectors for that Collection District-at each dwelling within
        that part or those parts of that Collection District in respect of
        which, in accordance with instructions given to him under regulation
        11, he is to perform his duties as Collector.



"(2) Subject to sub-regulation (3), a Collector for a specified dwelling
shall, on or before the Census day, leave a Householder's Schedule at the
dwelling.



"(3) Except with the approval of the Divisional Field Supervisor for the
Census Division, or the Group Leader for the Census Sub-division, in which the
relevant dwelling is included, a Collector shall not leave a Householder's
Schedule at a dwelling earlier than 7 days before the Census day.



"(4) The Householder's Schedule shall be left at a dwelling-

   (a)  by its being delivered to the occupier of the dwelling personally;

   (b)  by its being delivered to a person apparently in charge of, or
        residing at, the dwelling;

   (c)  if no person is in the dwelling at the time the Collector calls at the
        dwelling-by its being placed in some place in the dwelling where it is
        likely to come to the notice of the occupier; or

   (d)  by such other means as the Australian Field Supervisor directs.



"(5) A person, not being the occupier of a dwelling-

   (a)  who receives the Householder's Schedule left in respect of that
        dwelling;

   (b)  into whose hands that Householder's Schedule comes; or

   (c)  who receives notice of the fact that the Householder's Schedule has
        been left at the dwelling, shall deliver the Householder's Schedule to
        the occupier of the dwelling or give him notice that the Householder's
        Schedule has been left at the dwelling, as the case requires.

Penalty for a contravention of this sub-regulation: $10.

Persons who do not wish to provide information for inclusion in a
Householder's Schedule

"13. (1) Where-

   (a)  the occupier of a dwelling has reason to believe that a person abiding
        in the dwelling on the night of the Census day may not wish to furnish
        to the occupier the particulars that the occupier is required to
        supply in respect of that person in the Householder's Schedule for the
        dwelling; and

   (b)  the occupier so informs the Collector responsible for the delivery of
        a Householder's Schedule at the dwelling, the Collector shall supply
        to the occupier, for completion by that person, a personal form
        containing the questions relating to the particulars in respect of a
        person that are required, under section 12 of the Act, to be specified
        in a Householder's Schedule.



"(2) Where a person abiding in a dwelling on the night of the Census day does
not wish to furnish to the occupier of the dwelling, for insertion in the
Householder's Schedule for that dwelling, the particulars that the occupier is
required to fill in and supply in respect of that person in that schedule, the
person-

   (a)  shall obtain a personal form from the occupier of the dwelling or a
        Householder's Schedule from a post office or police station;

   (b)  shall, to the best of his knowledge and belief and in accordance with
        the instructions contained in the personal form or Householder's
        Schedule, as the case may be, supply in that form or Schedule in
        respect of himself-

        (i)    in the case of a personal form-the particulars specified
               therein; or

        (ii)   in the case of a Householder's Schedule-the particulars
               specified therein, other than particulars in respect of the
               dwelling;

   (c)  shall sign the personal form or Householder's Schedule; and

   (d)  shall, not later than 7 days after the Census day, hand the personal
        form or Householder's Schedule, or an envelope containing the personal
        form or Householder's Schedule, to the occupier of the dwelling.

Penalty: $20.



"(3) The occupier of a dwelling shall, when he delivers the Householder's
Schedule for the dwelling to a Collector, deliver to the Collector any
personal form or Householder's Schedule, or any envelope containing a personal
form or Householder's Schedule, handed to him in accordance with
sub-regulation (2).

Penalty: $20.



"(4) The occupier of a dwelling shall not open, or cause or permit another
person to open, an envelope handed to him in accordance with sub-regulation
(2) before the envelope is delivered to the Collector in accordance with
sub-regulation (3).

Penalty for a contravention of this sub-regulation: $20.

Persons on trains, &c.



"14. (1) The Collector for a train, motor coach or aircraft shall deliver a
personal form to each person who-

   (a)  is travelling on the train, motor coach or aircraft on the night of
        the Census day; and

   (b)  will not be abiding in a dwelling during that night.



"(2) A person to whom a personal form has been delivered in accordance with
sub-regulation (1) shall, before leaving the train, motor coach or aircraft-

   (a)  to the best of his knowledge and belief and in accordance with the
        instructions contained in the personal form, supply in it in respect
        of himself the particulars specified therein;

   (b)  sign the personal form; and

   (c)  deliver the personal form to the Collector.

Penalty for a contravention of this sub-regulation: $20.

Persons may be required to furnish particulars

"15. (1) Where a Collector has reason to believe-

   (a)  that a person did not abide in a dwelling, and did not travel on a
        train, motor coach or aircraft, on the night of the Census day; or

   (b)  that-

        (i)    a person is a person in respect of whom particulars are
               required to be furnished under the Act or these Regulations;
               and

        (ii)   no such particulars in respect of the person have been
               furnished, the Collector shall-

   (c)  deliver to the person a personal form and require the person, to the
        best of his knowledge and belief and in accordance with the
        instructions contained in the form, to supply in it in respect of
        himself the particulars specified therein; or

   (d)  require the person to furnish to the Collector such particulars as are
        necessary to enable a personal form to be completed in respect of that
        person.



"(2) Where a Collector for a Collection District has reason to believe that a
Householder's Schedule has not been filled up and delivered in respect of a
dwelling within that Collection District or within the part or a part of that
Collection District in respect of which he is to perform his duties as
Collector, as the case may be, the Collector shall require the person who was
the occupier of the dwelling on the night of the Census day to supply, in a
Householder's Schedule delivered to the person by the Collector, the
particulars that, in accordance with section 11 of the Act, the person is
required to supply in the Householder's Schedule.



"(3) A person shall comply with a requirement made under sub-regulation (1) or
(2).

Penalty for a contravention of this sub-regulation: $20.

Obligation of persons where particulars have not been supplied

"16. Where-

   (a)  a Householder's Schedule was not delivered in accordance with these
        Regulations to a person who was the occupier of a dwelling on the
        night of the Census day;

   (b)  a personal form was not delivered to a person who was entitled, under
        sub-regulation 14 (1), to have a personal form delivered to him; or

   (c)  a person who did not abide in a dwelling, and did not travel on a
        train, motor coach or aircraft, on the night of the Census day, has
        not been required by a Collector to comply with a requirement made
        under sub-regulation 15 (1), that person shall, as soon as practicable
        after the Census day-

   (d)  obtain from a post office or police station a Householder's Schedule;

   (e)  supply in the Householder's Schedule the particulars that are required
        to be supplied by him;

   (f)  sign the Householder's Schedule; and

   (g)  deliver the Householder's Schedule in accordance with the instructions
        furnished with it.

Penalty: $20.
