These Regulations shall come into operation on 1 July 1983. 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 2 Application of these Regulations in the Cocos Islands 2. Regulation 2 of the Quarantine (Animals) Regulations is amended by inserting ", other than Part VIIIA," after "these Regulations" (first occurring). 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 3 Interpretation 3. Regulation 4 of the Quarantine (Animals) Regulations is amended by omitting from sub-regulation (3) "the Forms contained in Schedule 1" and substituting "a form prescribed by these Regulations". 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 4 4. After Part VIII of the Quarantine (Animals) Regulations the following Part is inserted: "PART VIIIA-EXAMINATION OF ANIMALS FOR EXPORT Interpretation "86A. (1) In this Part, unless the contrary intention appears- 'animal' means a live animal; 'authority' means- (a) an authority of the Commonwealth, of a State, or of a Territory; or (b) a university or other teaching or research institution specified in Schedule 1 or 2 to the Commonwealth Tertiary Education Commission Act 1977 or a university or other teaching or research institution that is not so specified but is established by a law of the Commonwealth, of a State, or of a Territory; 'exempt exporter' means an authority that has exempt exporter status under sub-regulation 86C (1); 'recognized exporter' means a person who is a recognized exporter under regulation 86B. "(2) In this Part, other than in regulations 86D and 86E- (a) a reference to a consignment is a reference to a consignment within the meaning of regulation 86D or 86E; and (b) a reference to a service is a reference to a service within the meaning of regulation 86D or 86E. "(3) In this Part, a reference to the relevant number of charge periods to be multiplied by an amount to calculate the amount of the fee payable in respect of a service is a reference to the number of charge periods that, in accordance with sub-regulation (4), is applicable to the period comprising the total of- (a) the time during which the quarantine officer is occupied for the purpose of performing that service; and (b) the time during which the quarantine officer is reasonably occupied in proceeding to and returning from the place where that service is to be carried out. "(4) For the purposes of sub-regulation (3), where the period referred to in that sub-regulation- (a) is less than 15 minutes-one charge period is applicable to that period; (b) is a period of minutes the number of which, when divided by 15, yields a whole number-the number of charge periods that is the same as the number so yielded is applicable to that period; or (c) is a period of minutes the number of which, when divided by 15, yields a whole number and a fraction-the number of charge periods that is one more than the whole number so yielded is applicable to that period. "(5) For the purposes of this Part, where a service is provided over 2 or more days at least one of which is in one month and at least one of which is in a succeeding month, the service shall be regarded as having been provided during the month in which the latter or the last of those days falls. "(6) In this Part, a reference to the examination of a consignment includes, where the freedom or otherwise of the consignment from disease is or may be affected by the environment (including the animal population) from which the consignment has been drawn and by the surrounding animal population, a reference to the examination of that environment and of the surrounding animal population, as the circumstances require. Recognized exporters "86B. (1) Subject to sub-regulations (5) and (6), where the Director is satisfied that a person exports animals regularly he shall, on an application by that person, approve that person as a recognized exporter for the purposes of this Part. "(2) Where the Director makes a decision refusing to approve a person as a recognized exporter under sub-regulation (1) he shall notify that person in accordance with sub-regulation 86G (2), but a failure to comply with that sub-regulation or with this sub-regulation does not affect the validity of that decision. "(3) Where the Director is satisfied- (a) that a recognized exporter has ceased to export animals regularly; or (b) that a recognized exporter has failed to pay before the twenty-second day of the month next succeeding the month during which a service was provided a fee that is payable by that person in respect of that service, and is satisfied that the approval of that person as a recognized exporter should not continue, he shall revoke the approval of that person as a recognized exporter for the purposes of this Part. "(4) Where the Director makes a decision revoking the approval of a person as a recognized exporter under sub-regulation (3) he shall notify that person in accordance with sub-regulation 86G (2), but a failure to comply with that sub-regulation or with this sub-regulation does not affect the validity of that decision. "(5) Where the approval of a person as a recognized exporter is revoked and the person applies to be approved again as a recognized exporter, the Director shall not approve that person as a recognized exporter under sub-regulation (1) unless the person first pays all outstanding fees that he is liable to pay under this Part. "(6) Without limiting the operation of sub-regulation (5), where the approval of a person as a recognized exporter is revoked and the person applies within a period of 6 months of that revocation to be approved again as a recognized exporter, the Director shall not approve that person as a recognized exporter under sub-regulation (1) unless the Director, having regard to any relevant matter including- (a) the number of occasions in the past on which that person paid a fee that was payable by him as a recognized exporter in accordance with this Part- (i) within the time provided by this Part for payment of that fee; or (ii) after the time provided by this Part for payment of that fee, as the case may be; (b) any reason or reasons provided by that person for the payment of any fee or fees payable by him as a recognized exporter in accordance with this Part after the time provided by this Part for payment of that fee or those fees; and (c) prevailing economic conditions, is satisfied that if that person is again approved as a recognized exporter he will pay any fee payable by him as a recognized exporter in accordance with this Part within the time provided by this Part for payment of that fee. Exempt exporters "86C. (1) Where a person applies to the Director for the grant of exempt exporter status before a service relating to a consignment is provided for him and the Director is satisfied- (a) that the person is an authority; and (b) that the export is neither a commercial activity of the person nor in furtherance of a commercial activity of the person, the Director shall grant exempt exporter status to the person in respect of that consignment. "(2) Where the Director makes a decision refusing to grant a person exempt exporter status under sub-regulation (1), he shall notify that person in accordance with sub-regulation 86G (2), but a failure to comply with that sub-regulation or with this sub-regulation does not affect the validity of that decision. Examination of animals that are birds or mammals "86D. (1) In this Regulation and in Schedule 4A- 'applicable fee', in respect of a service relating to a consignment- (a) included in a class or classes of animals specified in Column 2 of Schedule 4A in an item in that Schedule-means the amount prescribed as the fee payable in respect of that service in accordance with sub-regulation (7) or (8), whichever is applicable; or (b) not included in a class or classes of animals specified in that Schedule, means the amount prescribed as the fee payable in respect of that service in accordance with sub-regulation (10) or (11), whichever is applicable; 'consignment' means- (a) an animal being a bird or mammal (whether or not included in a class or classes of animals specified in an item in Schedule 4A) proposed for export; or (b) 2 or more- (i) animals being birds or mammals included in a class or classes of animals specified in an item in Schedule 4A; or (ii) animals being birds or mammals that are not included in a class or classes of animals specified in an item in Schedule 4A, proposed for export to one importer from one port at the same time on the one vessel for one country; 'declaration' means a declaration under sub-regulation (5); 'service' means- (a) any preliminary test, or other activity, required for the purpose of enabling the examination of a consignment under sub-regulation (3) and the grant of certificates under sub-regulation (4) relating to that examination; (b) the examination under sub-regulation (3) of that consignment; and (c) the grant of any certificates under sub-regulation (4) relating to that consignment. "(2) For the purpose of paragraph (b) of the definition of 'consignment' in sub-regulation (1), a reference to 2 or more animals included in classes of animals specified in an item in Schedule 4A is a reference to 2 or more animals- (a) both or all of which are included in one of those classes of animals; (b) each of which is included in a different class specified in that item; or (c) one or more of which is or are included in one of those classes and the remaining animal or animals is or are included in the other classes or in one or more or all of the remaining classes of animals. "(3) A person shall not export a consignment unless the consignment has been examined at the port of shipment during the period of 48 hours immediately preceding shipment by a quarantine officer who is a veterinary surgeon. "(4) Subject to sub-regulations (5) and 86F (2), a quarantine officer who examines a consignment in accordance with sub-regulation (3) shall grant such certificates relating to the freedom of the consignment from disease or otherwise as the circumstances require. "(5) A quarantine officer shall not grant a certificate under sub-regulation (4) in respect of a consignment being an animal or animals included in the classes of animals specified in Item 18 of Schedule 4A proposed to be exported by a person, other than a person who is an exempt exporter in respect of that consignment, unless the person first makes and submits to the officer a declaration in the following form: 'I (here insert name of the person) declare that the export of (here describe the animal or animals comprising the consignment) is neither a commercial activity nor in furtherance of a commercial activity. (here insert date on which the declaration is made) (Signature of the person)'. "(6) A person shall not make or submit to a quarantine officer a declaration that is false in a material particular. "(7) Subject to sub-regulation (8), in respect of a service relating to a consignment included in a class or classes of animals specified in Column 2 of Schedule 4A in an item in that Schedule, the amount (if any) specified in Column 4 of that Schedule in that item is the fee payable in respect of that service. "(8) Where, in respect of a service relating to a consignment included in a class or classes of animals specified in Column 2 of Schedule 4A in an item in that Schedule- (a) no amount is specified in Column 4 in that item; or (b) the Column 3 amount that is applicable to the consignment exceeds the amount specified in Column 4 in that item, the Column 3 amount is the fee payable in respect of that service. "(9) A reference in sub-regulation (8) to the Column 3 amount that is applicable to a consignment included in a class or classes of animals specified in Column 2 of Schedule 4A in an item in that Schedule is a reference to- (a) where a rate is specified in Column 3 of that Schedule in that item, or, where 2 rates are specified in Column 3 of that Schedule in that item but only one of them is applicable to that consignment-the amount calculated by multiplying that rate or the applicable rate, as the case may be, by the number of animals in that consignment; (b) where 2 rates are specified in Column 3 of that Schedule in that item and both of them are applicable to that consignment-the amount calculated by multiplying each of those rates by the number of animals in that consignment to which each of those rates is applicable and adding the sum of those products; (c) where an amount is specified in Column 3 of that Schedule in that item, or, where 2 or more amounts are specified in Column 3 of that Schedule in that item but only one of them is applicable to that consignment-that amount or the applicable amount, as the case may be; or (d) where 2 or more amounts are specified in Column 3 of that Schedule in that item and 2 or more of those amounts are applicable to that consignment-the amount calculated by adding together the amounts that are applicable to that consignment. "(10) Subject to sub-regulation (11), in respect of a service relating to a consignment being birds or mammals that are not included in a class specified in Column 2 of Schedule 4A, a fee of an amount calculated by multiplying $3.75 by the relevant number of charge periods is the fee payable in respect of that service. "(11) Where, in accordance with sub-regulation (10), an amount of less than $10 would, but for this sub-regulation, be payable in respect of a service relating to a consignment, an amount of $10 is the fee payable for that service in place of the fee that would otherwise be applicable under sub-regulation (10). Examination of animals other than birds or mammals "86E. (1) In this regulation and in Schedule 4B- 'applicable fee', in respect of a service relating to a consignment- (a) included in a class of animals specified in Column 2 of Schedule 4B in an item in that Schedule-means the amount prescribed as the fee payable in respect of that service in accordance with sub-regulation (4); or (b) not included in a class of animals specified in that Schedule, means the amount prescribed as the fee payable in respect of that service in accordance with sub-regulation (5) or (6), whichever is applicable; 'consignment' means- (a) an animal, other than a bird or mammal, (whether or not included in a class of animals specified in an item in Schedule 4B) proposed for export; or (b) 2 or more- (i) animals, other than birds or mammals, included in a class of animals specified in an item in Schedule 4B; or (ii) animals, other than birds or mammals, that are not included in a class of animals specified in Schedule 4B, proposed for export to one importer from one port at the same time on the one vessel for one country; 'service' means- (a) any preliminary test, or other activity, required for the purpose of enabling the examination of a consignment under sub-regulation (2) and the grant of certificates under sub-regulation (3) relating to that examination; (b) the examination under sub-regulation (2) of that consignment; and (c) the grant of any certificates under sub-regulation (3) relating to that consignment. "(2) Where requested to do so, a quarantine officer may examine a consignment. "(3) Subject to sub-regulation 86F (2), a quarantine officer who examines a consignment in pursuance of a request under sub-regulation (2) shall grant such certificates relating to the freedom of the consignment from disease or otherwise as the circumstances require. "(4) In respect of a service relating to a consignment included in a class of animals specified in Column 2 of Schedule 4B in an item in that Schedule, the amount specified in Column 3 of that Schedule in that item is the fee payable in respect of that service. "(5) Subject to sub-regulation (6), in respect of a service relating to a consignment of animals other than birds or mammals, being animals that are not included in a class specified in Column 2 of Schedule 4B, a fee of an amount calculated by multiplying $3.75 by the relevant number of charge periods is the fee payable in respect of that service. "(6) Where, in accordance with sub-regulation (5), an amount of less than $10 would, but for this sub-regulation, be payable in respect of a service relating to a consignment, an amount of $10 is the fee payable in respect of that service in place of the fee that would otherwise be applicable under sub-regulation (5). Issue of export certificates and payment of applicable fees "86F. (1) In this regulation- 'applicable fee', in relation to a service provided under regulation 86D or 86E, means the fee that is applicable to that service in accordance with that regulation; 'export certificate', in relation to a consignment means the certificate or certificates granted under sub-regulation 86D (4) or 86E (3), as the case may be, in respect of the examination of that consignment; "(2) Where a quarantine officer has provided a service relating to a consignment for a person, other than- (a) a person who, at the time of completion of that service, is a recognized exporter; or (b) a person who is an exempt exporter in respect of that consignment, the officer shall not issue to that person the export certificates relating to that consignment unless and until that person pays the applicable fee in respect of that service. "(3) The liability of a person to pay the applicable fee in respect of a service relating to a consignment is not affected if the export certificates granted in respect of the examination of that consignment are issued before payment of that fee. "(4) Where a service relating to a consignment is provided for a recognized exporter he shall pay the applicable fee in respect of that service before the twenty-second day of the month next succeeding the month during which that service is provided. "(5) Where the applicable fee payable by a recognized exporter in respect of a service (in this regulation called 'the nominal applicable fee') is not paid before the twenty-second day of the month next succeeding the month during which that service was provided, the amount ascertained in accordance with sub-regulation (6) is the fee payable in respect of that service in place of the nominal applicable fee. "(6) The amount referred to in sub-regulation (5) shall be ascertained by adding to the amount of the nominal applicable fee an amount equal to 1.5 per cent of that amount for each month or part of a month for which the nominal applicable fee remains unpaid. "(7) Where a service relating to a consignment is provided for a person who, at the time of completion of that service, was a recognized exporter, the subsequent revocation of the approval of that person as a recognized exporter does not affect the continued operation, or the possible operation, of sub-regulation (4), (5) or (6) in relation to the fee payable in respect of that service by that person. "(8) Where the fee prescribed under sub-regulation (5) is payable by a person and the Director, on an application by that person, is satisfied that it is just and equitable in all the circumstances to do so, he shall waive payment of the whole or any part of so much of that fee as exceeds the nominal applicable fee by reference to which that fee was ascertained. "(9) Where, on the application of a person, the Director makes a decision refusing to waive payment of part of a fee under sub-regulation (8) he shall notify that person in accordance with sub-regulation 86G (2), but a failure to comply with that sub-regulation or with this sub-regulation does not affect the validity of that decision. "(10) A person who is an exempt exporter in respect of a consignment in relation to which a service has been provided is not liable to pay any fees prescribed by the regulation under which that service was provided. Review of decisions "86G. (1) An application may be made to the Administrative Appeals Tribunal for the review of a decision of the Director- (a) refusing to approve a person as a recognized exporter under sub-regulation 86B (1); (b) revoking the approval of a person as a recognized exporter under sub-regulation 86B (3); (c) refusing to grant a person exempt exporter status under sub-regulation 86C (1); or (d) refusing to waive payment of part of a fee under sub-regulation 86F (8). "(2) For the purpose of sub-regulation 86B (2), 86B (4), 86C (2) or 86F (9), the Director shall, by notice in writing served personally or by post on the person referred to in that sub-regulation, notify him of- (a) the making of the decision referred to in that sub-regulation; and (b) his right, subject to the Administrative Appeals Tribunal Act 1975 , to apply to the Administrative Appeals Tribunal for a review of that decision. Delegation "86H. (1) In this regulation, 'Secretary' means the Secretary to the Department of Primary Industry. "(2) The Director may, by writing signed by him, delegate, either generally or as otherwise provided in the instrument of delegation, to the Secretary any of his powers under this Part, other than this power of delegation. "(3) An instrument under sub-regulation (2) may describe the Secretary by name or by reference to the office of Secretary. "(4) The Secretary may, by writing signed by him delegate, either generally or as otherwise provided in the instrument of delegation, to a person any of the powers delegated to him under sub-regulation (2). "(5) An instrument under sub-regulation (4) may describe the delegate by name or, where appropriate, by reference to an office created under a law of the Commonwealth, of a State or of a Territory. "(6) Where an instrument under sub-regulation (2) or (4) is expressed to delegate powers to a person who is described by reference to an office, the instrument operates to delegate those powers to each person for the time being performing the duties of that office (whether or not as the holder of that office) while that instrument remains in force. "(7) A power delegated under sub-regulation (2), when exercised or performed by the delegate, shall not for the purposes of these Regulations be regarded as being exercised or performed by the Director but shall be regarded as being exercised or performed by the Secretary as effectively as if that power had been directly conferred on the Secretary by a provision of these Regulations. "(8) A power delegated under sub-regulation (4), when exercised by the delegate, shall, for the purposes of these Regulations, be deemed to have been exercised by the Secretary as effectively as if that power had been directly conferred on the Secretary by a provision of these Regulations. "(9) A delegation under this regulation does not prevent the exercise of a power by the Director.". 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 5 Repeal of regulation 96A 5. (1) Regulation 96A of the Quarantine (Animals) Regulations is repealed. (2) A certificate granted to a person under sub-regulation 96A (2) of the Quarantine (Animals) Regulations and in force immediately before the commencement of these Regulations shall be deemed to have been granted under sub-regulation 86D (4) of the Quarantine (Animals) Regulations as amended by these Regulations. 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 6 Schedule 4 6. Schedule 4 to the Quarantine (Animals) Regulations is amended- (a) by omitting from Item 1 "in quarantine" and substituting "ordered into, or subject to, quarantine"; (b) by inserting in Item 4 "imported" after "Inspection of consignment of"; and (c) by inserting in Item 5 "imported" after "Inspection of". 1983 No. 70 QUARANTINE (ANIMALS) REGULATIONS (AMENDMENT) - REG 7 7. (b) For so much of the consignment (if any) that exceeds 5 animals, the rate is $10 for each animal. 40 14 Pigs (a) For so much of the consignment that does not exceed 50 animals, the rate is $2 for each animal. 25 (b) For so much of the consignment (if any) that exceeds 50 animals, the rate is 10 cents for each animal. 15 Rabbits (a) For so much of the consignment that does not exceed 20 animals, the rate is $1 for each animal. 20 (b) For so much of the consignment (if any) that exceeds 20 animals, the rate is 20 cents for each animal. 16 Poultry (a) For so much of the consignment that does not exceed 200 birds, the rate is 20 cents for each bird. 40 (b) For so much of the consignment (if any) that exceeds 200 birds, the rate is 10 cents for each bird. 17 Day-old-chicks (a) For so much of the consignment that does not exceed 1,000 birds, an amount of $25. 25 (b) For so much of the consignment (if any) that exceeds 1,000 birds, an amount of $2 for each 1,000 birds, and for so much of the remainder of the consignment (if any) that is not divisible exactly by 1,000, an amount of $2for that remainder. 18 Dogs, cats, birds the subject of, or included in, a declaration An amount of $10 - 19 Dogs other than dogs the subject of, or included in, a declaration (a) Where the consignment comprises one or more animals, the rate is $10 forthat animal or for the first of those animals. - (b) For so much of the consignment (if any) that exceeds one animal, the rate is $5 for each animal. 20 Cats other than cats the subject of, or included in, a declaration (a) Where the consignment comprises one or more animals, the rate is $10 forthat animal or for the first of those animals. (b) For so much of the consignment (if any) that exceeds one animal, the rate is $5 for each animal. - 21 Birds other than birds the subject of, or included in, a declaration (a) For so much of the consignment that does not exceed 50 birds, the rate is 50 cents for each bird.
