Second Schedule 4. Formal amendments SCHEDULE 1 1980 No. 51 QUARANTINE (GENERAL) REGULATIONS (AMENDMENTS) - REG 1 1. After regulation 33B of the Quarantine (General) Regulations the following regulation is inserted: Disposal of refuse "33C. (1) Notwithstanding the provisions of regulation 33A, the master or owner of a vessel to which this regulation applies shall- (a) within a period of 24 hours of entering a declared port; and (b) at least once, while the vessel remains in or near that port, during- (i) each subsequent period the duration of which is determined by a quarantine officer; or (ii) where no determination is made under sub-paragraph (i)-each subsequent period of 24 hours, make available for collection, by a person authorized by a Chief Quarantine Officer under regulation 34, all animal waste, organic refuse, galley scraps or waste (other than rendered fat) from that vessel. Penalty: $2,000. "(2) Subject to sub-regulation (3) and (4) this regulation applies to- (a) all oversea vessels arriving at a declared port; and (b) all Australian vessels arriving at a declared port from another port carrying, or for the purpose of carrying on departure from that declared port- (i) for the purposes of trade and commerce, any goods, animals or plants; or (ii) more than 10 persons including at least 1 person carried as a paying passenger, and remaining in or near that declared port for a period of at least 24 hours. "(3) A Chief Quarantine Officer may exempt, by instrument in writing, a vessel, being a vessel that carries and has in use waste disposal facilities approved in that instrument by that Officer, in respect of- (a) the type of refuse, scraps or waste; (b) the period; and (c) the declared port, specified in the instrument, from compliance with sub-regulation (1). "(4) The Director of Quarantine may exempt any vessel or class of vessels from compliance with the requirements of this regulation. "(5) For the purposes of this regulation and item 9 of Part I of Schedule 2, 'declared port' means a port declared by the Minister, by notice published in the Gazette, to be a port to which this regulation applies.". 1980 No. 51 QUARANTINE (GENERAL) REGULATIONS (AMENDMENTS) - REG 2 Removal and destruction of garbage 2. Regulation 34 of the Quarantine (General) Regulations is amended by omitting sub-regulation (3) and substituting the following sub-regulation: "(3) A person, not being a person authorized under sub-regulation (1), shall not remove, from a vessel that is at a port, any animal waste, organic refuse, galley scraps or waste (other than rendered fat) except for the purpose of sub-regulation 33C (1) or for the purpose of destroying or disposing of it in a manner specified by a quarantine officer under paragraph 35 (1) (b). The Second Schedule to the Quarantine (General) Regulations is amended by inserting after item 8 in Part I the following item: "9 Disposal of refuse, galley scraps or waste (other than rendered fat) from a vessel that is 25 metres or more in length and to which sub-regulation 33C (1) applies, where the vessel, upon arrival at a declared port, carried- (a) less than 21 people-for each day in that port . . . 35.00 (b) more than 20 people but less than 51 people-for each day in that port . . . . . . . . . . . . . . . . . . 45.00 (c) more than 50 people but less than 151 people-for each day in that port . . . . . . . . . . . . . . . . . . 50.00 (d) more than 150 people-for each day in that port . . 70.00". 1980 No. 51 QUARANTINE (GENERAL) REGULATIONS (AMENDMENTS) - REG 4 Formal amendments 4.
