| - Description: | These Regulations amend the Migration Regulations 1994 to clarify the arrangements for nomination and sponsorship for Subclass 457 visas. The amendments clarify that in considering approval of nomination of business activities, the Minister is to have regard to occupations specified in the relevant Gazette Notice at the time of making the decision and not at the time of making the nomination. The amendments also provide that a visa may not be granted unless the occupation continues to be specified in the Gazette Notice, and that in certain circumstances the nomination fee or visa application charge may be refunded if approval is prevented by a change in the Gazette Notice. |
