Fees for transactions involving the movement of goods out of warehouses 1985 No. 71 CUSTOMS REGULATIONS (AMENDMENT) - REG 1 Commencement 1. These Regulations shall come into operation on 1 July 1985. 1985 No. 71 CUSTOMS REGULATIONS (AMENDMENT) - REG 2 Fees in respect of warehouse licences 2. Regulation 50 of the Customs Regulations is amended- (a) by omitting sub-regulation (2) and substituting the following sub-regulations: "(2) For the purpose of section 85 of the Act, the prescribed fee for the grant of a warehouse licence, being a licence that comes into force on 1 July, is a fee equal to the amount of the sum of $6,646 and any additional amount payable under sub-regulation (2C) less any amount that may be deducted under sub-regulation (2D). "(2A) For the purpose of section 85 of the Act, the prescribed fee for the grant of a warehouse licence, being a licence that comes into force on a date other than 1 July, is a fee equal to the amount that bears the same proportion to the fee that would have been payable under sub-regulation (2) if the licence had come into operation on 1 July as the number of days from and including that other date to and including the next succeeding 30 June bears to 365. "(2B) For the purpose of section 85 of the Act, the prescribed fee for the renewal of a warehouse licence is a fee equal to the amount of the sum of $5,346 and any additional amount payable under sub-regulation (2C) less any amount that may be deducted under sub-regulation (2D). "(2C) For the purposes of sub-regulations (2) and (2B), the following additional amounts are payable in respect of the grant or renewal of a warehouse licence: (a) where the licence relates to a warehouse other than a duty free shop and authorizes the receiving, stacking, arranging, storing or delivering of bulk liquids (other than potable spirits)-$340; (b) where the licence relates to a warehouse other than a duty free shop and authorizes the receiving, stacking, arranging, storing or delivering of goods (other than bulk liquids or potable spirits) that are the property of the licensee or of an associated company of the licensee but does not authorize the receiving, stacking, arranging, storing or delivering of any other goods-$240; (c) where the licence relates to a warehouse other than a duty free shop and authorizes the receiving, stacking, arranging, storing or delivering of goods (other than bulk liquids or potable spirits) that are the property of a person other than the licensee or an associated company of the licensee-$210; (d) where the licence relates to a warehouse other than a duty free shop and authorizes the receiving, stacking, arranging, storing, blending, reducing, bottling, packing or delivering of potable spirits-$310; (e) where the licence relates to a manufacturing warehouse and goods in the warehouse are, or are intended to be, utilized for the manufacture of any goods referred to in regulation 71 or 73-$160; (f) where the licence relates to a duty free shop-$300; (g) where the warehouse to which the licence relates is an approved place for the purposes of the Excise Act 1901 or is the subject of an application under section 5A of that Act-$340. "(2D) For the purposes of sub-regulations (2) and (2B), the following amounts may be deducted in calculating the amount of the prescribed fee for the grant or renewal of a warehouse licence: (a) where the system of recording and accounting used in relation to the warehouse includes the use of a computer having a facility for real time status reporting-$100; (b) where the system of recording and accounting used in relation to the warehouse includes the use of a computer having a facility for monthly status reporting-$250; (c) where the system of recording and accounting used in relation to the warehouse includes the use of a computer having both facilities referred to in paragraphs (a) and (b)-$350."; (b) by omitting from sub-regulation (3) "paragraph (2) (a)" and substituting "sub-regulations (2) and (2B)"; (c) by omitting from paragraph (3) (b) "of $475" and substituting ", each of an amount equal to one-quarter of the amount of the fee,"; (d) by omitting from sub-regulation (4) "paragraph (2) (b)" and substituting "sub-regulation (2A)"; (e) by omitting sub-paragraph (4) (a) (ii) and substituting the following sub-paragraph: "(ii) by an instalment, being an instalment of an amount equal to one-half of the amount of that fee, on the first day of the period and by 2 further instalments, each of an amount equal to one-quarter of the amount of that fee, on 1 January and 1 April, respectively, in that year,"; and (f) by omitting sub-paragraph (4) (b) (ii) and substituting the following sub-paragraph: "(ii) by an instalment, being an instalment of an amount equal to three-quarters of the amount of that fee, on the first day of the period and by a further instalment, of an amount equal to one-quarter of the amount of that fee, on 1 April in that year,". 1985 No. 71 CUSTOMS REGULATIONS (AMENDMENT) - REG 3 Fees for transactions involving the movement of goods out of warehouses 3. Regulation 52 of the Customs Regulations is amended- (a) by omitting sub-regulation (1) and substituting the following sub-regulation: "(1) For the purposes of section 85 of the Act, the following fees are prescribed in respect of the following transactions involving the movement of dutiable goods out of a warehouse to which a warehouse licence relates: (a) the giving of an authority under section 39 of the Act for goods warehoused in the warehouse to be dealt with in accordance with an entry for home consumption made in respect of those goods-a fee of $7; (b) the lodging with the Customs by a licensee, in accordance with a condition of a permission given to the licensee under section 71B of the Act, of a document setting out particulars of dutiable goods delivered for home consumption from the warehouse under the authority of the permission during each period specified in, or determined in accordance with, the permission-a fee calculated at the rate of $7 for each page of the document."; and (b) by omitting sub-regulation (5). - NOTES 1985 No. 71*1* CUSTOMS REGULATIONS*2* (AMENDMENT) *1* Notified in the Commonwealth of Australia Gazette on 20 May 1985. *2* Statutory Rules 1926 No. 203 as amended to date.
