Review of certain awards
- (1)
- Within 12 months after this section commences,
the Commission must review all awards containing clauses that provide for, or
regulate, tallies in the meat industry and, after considering appropriate
alternatives, may vary an award to remove such clauses.
- (2)
- Any clause that provides for, or regulates, tallies in the meat industry
that is contained in an award ceases to have effect at the end of 12 months
after this section commences.
- (3)
- After the end of the period of time mentioned in subsection (2), the
Commission may vary any award to remove any clauses that have ceased to have
effect because of subsection (2).
- (4)
- If the Commission varies an award under subsection (1) or (3), it must
include in the award provisions that ensure that overall entitlements to pay
provided by the award are not reduced by that variation, unless the Commission
considers that it would be in the public interest not to include such
provisions.
