WHEAT MARKETING ACT 1979 No. 166 of 1979 - SECT 39

Appointment of officers
39. (1) The Board may appoint such officers of the Board as are necessary to
assist the Board in carrying out its functions or exercising its powers.

(2) Officers appointed in pursuance of this section shall be employed on such
terms and conditions (including terms and conditions with respect to
punishment for breaches of discipline) as are determined by the Board with the
approval of the Public Service Board.

(3) A person employed by the Board immediately before the commencement of this
Act shall be deemed to have been appointed under this section.

(4) A determination by the Board of terms and conditions of employment of
officers of the Board that was in force immediately before the commencement of
this Act continues in force, subject to any determination made under this
section.

(5) Where an officer appointed or deemed to be appointed under this section
was, immediately before his appointment as an officer of the Board, an officer
of the Australian Public Service or a person to whom the Officers' Rights
Declaration Act 1928 applied-

   (a)  he retains his existing and accruing rights;

   (b)  for the purpose of determining those rights, his service as an officer
        of the Board shall be taken into account as if it were service in the
        Australian Public Service; and

   (c)  the Officers' Rights Declaration Act 1928 applies as if this Act and
        this section has been specified in the Schedule to that Act.
