TELECOMMUNICATIONS (TRANSITIONAL PROVISIONS AND CONSEQUENTIAL AMENDMENTS) ACT 1997 No. 59 of 1997 - SECT 69
69 Confidentiality of communications carried on or after 1 July 1997
(1) Part 13 of the Telecommunications Act 1997 does not apply to information
or a document that comes to a person's knowledge, or into a person's
possession, unless:
(a) the information or document relates to:
(i) the contents or substance of a communication that has been
carried on or after 1 July 1997; or
(ii) the contents or substance of a communication that is being
carried on or after 1 July 1997 (including a communication that
has been collected or received but has not been delivered); or
(iii) carriage services supplied, or intended to be supplied, on or
after 1 July 1997; or
(b) both:
(i) the information or document relates to the affairs or personal
particulars (including any unlisted telephone number or any
address) of another person; and
(ii) the information or document came to the first-mentioned
person's knowledge, or into the first-mentioned person's
possession, on or after 1 July 1997.
(2) An expression used in this section and in Part 13 of the
Telecommunications Act 1997 has the same meaning in this section as it has in
Part 13 of the Telecommunications Act 1997.
