TRADE PRACTICES AMENDMENT ACT 1977 No. 81 of 1977 - SECT 75

75. Section 163A of the Principal Act is amended by omitting sub- section (3)
and substituting the following sub-section:-

''(3) The Commission is not entitled to institute a proceeding in the Court
under this section but may intervene in a proceeding instituted in the Court
or in any other court, being a proceeding-

   (a)  that involves a matter arising under Part IV other than a matter
        arising under section 48; and

   (b)  in which a party is seeking the making of a declaration of a kind
        mentioned in paragraph (1) (a).''.
