TRADE PRACTICES ACT 1974 No. 51, 1974 - SECT 163

Prosecutions.
163. (1) Prosecutions for offences against this Act shall be brought only in
the Court.

(2) Jurisdiction is conferred on the Court to hear and determine prosecutions
under this Act.

(3) The jurisdiction of the Court in respect of an offence against a provision
of Division 3 or 4 of Part X shall be exercised by not less than 3 Judges.

(4) Proceedings before the Court in accordance with this section-

   (a)  may be instituted by summons upon information; and

   (b)  shall not be instituted except with the consent in writing of the
        Attorney-General or of a person authorized by the Attorney-General, by
        writing under his hand, to give such consents.

(5) A prosecution for an offence against section 118 may be commenced at any
time after the commission of the offence.
