TRADE PRACTICES ACT 1974 No. 51, 1974 - SECT 138

138. Where a person enters into, or purports to enter into, a transaction that
involves a failure by him to comply with an undertaking given to the Tribunal,
a person who is not bound by the undertaking has the same rights and title,
whether as a party to the transaction or as a person claiming directly or
indirectly under a party to the transaction, as he would have had if the
transaction had not involved such a failure.
