TRADE MARKS ACT 1994 No. 156 of 1994 - SECT 94

94. If:

   (a)  an application has been made to the Registrar under subsection 92(1);
        and

   (b)  the Registrar is of the opinion that the matter should be decided by a
        prescribed court; the Registrar may refer the matter to that court and
        the court may hear and determine the matter as if an application had
        been made to it under subsection  92(3).
