TELECOMMUNICATIONS ACT 1997 No. 47 of 1997 - SECT 63

Conditions applying to each carrier licence

(1) The Minister may, by written instrument, declare that each carrier licence
is subject to such conditions as are specified in the instrument.

Conditions applying to specified existing carrier licences

(2) The Minister may, by written instrument, declare that a specified carrier
licence is subject to such conditions as are specified in the instrument.
Note: A licence may be specified by name, by inclusion in a specified class or
in any other way.

Conditions applying to specified future carrier licences

(3) The Minister may, by written instrument, declare that, in the event that a
carrier licence is granted to a specified person during a specified period,
the carrier licence is subject to such conditions as are specified in the
instrument.

Declarations have effect

(4) A declaration under this section has effect accordingly. Variation of
conditions

(5) The Minister may, by written instrument, vary an instrument under
subsection (1), (2) or (3).

Revocation of conditions

(6) The Minister may, by written instrument, revoke an instrument under
subsection (1), (2) or (3).

Notification of conditions-existing licences

(7) As soon as practicable after the Minister makes an instrument under
subsection (1), (2), (5) or (6) that relates to a licence, the Minister must
give the holder of the licence a copy of the instrument.

Notification of conditions-future licences

(8) As soon as practicable after the Minister makes an instrument under
subsection (3) that relates to a licence, the Minister must give the applicant
for the licence a copy of the instrument.

Validity not affected by failure to notify conditions

(9) A contravention of subsection (7) or (8) does not affect the validity of
an instrument.

Gazettal

(10) A copy of an instrument under subsection (1), (2), (3), (5) or (6) is to
be published in the Gazette.

Date of effect-existing licences

(11) An instrument under subsection (1), (2), (5) or (6) takes effect:

   (a)  on the day on which a copy of the instrument is published in the
        Gazette; or

   (b)  if the instrument specifies a later day-on that later day.

Date of effect-future licences

(12) An instrument under subsection (3) relating to a licence takes effect
when the licence is granted.

Disallowable instrument

(13) An instrument under subsection (1), (2), (3), (5) or (6) is a
disallowable instrument for the purposes of section 46A of the Acts 
Interpretation Act 1901.
