TELECOMMUNICATIONS ACT 1997 No. 47 of 1997 - SECT 41

41 Simplified outline
The following is a simplified outline of this Part:
. The owner of a network unit that is used to supply carriage services to the
public must hold a carrier licence unless:

   (a)  a nominated carrier declaration is in force in relation to the network
        unit; or

   (b)  an exemption applies.
. Carrier licences are granted by the ACA.
. The holder of a carrier licence is known as a carrier.
. If responsibility for a network unit is transferred from the owner of the
unit to a carrier, the ACA may make a nominated carrier declaration that
declares the carrier to be the nominated carrier in relation to the unit.
. Carrier licences are subject to conditions.
