TELECOMMUNICATIONS ACT 1991 No. 98 of 1991 - SECT 159

AUSTEL's way of operating
159. (1) AUSTEL must, in conducting an arbitration for the purposes of section
154, pursue the objective of providing a mechanism of arbitration that is
fair, just, economical, informal and quick.

(2) AUSTEL, in conducting an arbitration:

   (a)  is not bound by technicalities, legal forms or rules of evidence; and

   (b)  must act according to substantial justice and the merits of the case;
        and

   (c)  must have regard to:

   (i)  the rights of the carriers under section 137; and

   (ii) any applicable licence conditions, including supplementary access
        conditions; and

   (iii) any applicable determination in force under section 140.
