SOCIAL SECURITY LEGISLATION AMENDMENT ACT 1982 No. 98, 1982 - SECT 69

69. Section 104 of the Principal Act is amended-

   (a)  by omitting sub-section (1) and substituting the following
        sub-section:

''(1) Where-

   (a)  a person is employed by the Commonwealth, by a State or by the
        Northern Territory, or by an authority of the Commonwealth, of a State
        or of the Northern Territory, and is temporarily stationed outside
        Australia;

   (b)  a person is not in Australia and is the spouse of an employee referred
        to in paragraph (a);

   (c)  a person is not in Australia and is a member of the Defence Force;

   (d)  a person is not in Australia and is the spouse of a member of the
        Defence Force; or

   (e)  a person whose usual place of residence is in Australia is temporarily
        absent from Australia,

and that person has the custody, care and control of one or more children,
this Part shall have effect as if that person and each of those children were
in Australia.'';

   (b)  by omitting from sub-section (4) ''a woman'' and substituting ''a
        person'';

   (c)  by omitting from sub-section (4) ''she'' and substituting ''the
        person'';

   (d)  by omitting from sub-section (4) ''her'' and substituting ''the
        person''; and

   (e)  by omitting from sub-section (5) ''man or woman'' (wherever occurring)
        and substituting ''person''.
