SOCIAL SECURITY AND VETERANS' AFFAIRS LEGISLATION AMENDMENT ACT 1990 No. 56, 1990 - SECT 19

19. After section 152 of the Principal Act the following section is inserted:
Secretary may require persons to take action to obtain compensation

"152A. (1) Where a person who is in receipt of a pension, or is eligible or
qualified to receive a pension:

   (a)  is or may be entitled, in the opinion of the Secretary, to a payment
        by way of compensation; and

   (b)  has taken no action, or no action that the Secretary considers
        reasonable, to claim or obtain such payment; the Secretary may require
        the person to take the action specified by the Secretary, being action
        that the Secretary considers reasonable to enable the person to claim
        or obtain such payment.

"(2) Where the Secretary requires a person to take action, the person must not
be granted the relevant pension, or the relevant pension ceases to be payable
to the person, as the case may be, unless the person complies with the
requirement.

"(3) Where a person complies with a requirement, the person is taken, for the
purposes of this Act, to be eligible or qualified to receive the pension which
he or she was eligible or qualified to receive before the requirement was
made.".
