SOCIAL SERVICES AMENDMENT ACT (No. 3) 1976 No. 111, 1976 - SECT 15

15. Before section 48 of the Principal Act the following section is inserted
in Division 10 of Part III:- Disposal of income.
''47. (1) If, in the opinion of the Director-General, a claimant or a
pensioner has directly or indirectly deprived himself of income in order to
qualify for, or obtain, a pension, or in order to obtain a pension at a higher
rate than that for which he would otherwise have been eligible, the amount of
the income of which the Director-General considers the claimant or pensioner
has so deprived himself shall be deemed to be income of the claimant or
pensioner.

''(2) If, in the opinion of the Director-General, the spouse of a claimant or
of a pensioner has directly or indirectly deprived himself of income in order
that the claimant or pensioner might qualify for, or obtain, a pension, or in
order that the claimant or pensioner might obtain a pension at a higher rate
than the rate for which the claimant or pensioner would otherwise have been
eligible, the amount of the income of which the Director-General considers the
spouse has so deprived himself shall be deemed to be income of the spouse.''.
