SOCIAL SECURITY ACT 1991 No. 46, 1991 - SECT 88

Bereavement payments on death of dependent child
88. If:

   (a)  a person is receiving an age pension; and

   (b)  a dependent child of the person dies; and

   (c)  immediately before the child died, the person's age pension rate
        included:

   (i)  a dependent child add-on in respect of the child; or

   (ii) guardian allowance in respect of the child; the person is qualified
        for payments under this Subdivision to cover the bereavement period.
        Note 1: section 89 provides for age pension to be paid to the person,
        up to the first available bereavement adjustment payday, at the rate
        at which it would have been paid if the child had not died but were
        disregarded for the purposes of working out the person's income test
        free areas. Note 2: section 90 provides for a lump sum to be paid to
        the person if the person was receiving family allowance for the child
        and the first available bereavement adjustment payday occurs before
        the end of the bereavement period: the lump sum represents the
        difference, over the bereavement lump sum period, between the person's
        new age pension rate and the rate at which the pension would have been
        paid if the child had not died but were disregarded for the purposes
        of working out the person's income test free areas. Note 3: the
        additional payments preserved by this Subdivision are:
. dependent child add-on;
. guardian allowance;
. additional rent assistance;
. additional remote area allowance.
