SOCIAL SECURITY ACT 1991 No. 46, 1991 - SECT 48

Need for a claim
48. (1) A person who wants to be granted an age pension must make a proper
claim for that pension.
Note: for "proper claim" - see section 49 (form), section 50 (manner of
lodgment) and section 51 (residence/presence in Australia).

(2) For the purposes of subsection (1), if:

   (a)  a claim for age pension is made by or on behalf of a person; and

   (b)  at the time when the claim is made, the claim cannot be granted
        because the person is not qualified for that pension; the claim is to
        be taken to have not been made.
