SOCIAL SECURITY ACT 1991 No. 46, 1991 - SECT 369

369. (1) A woman who wants to be granted a widow B pension must make a
proper claim for that pension. Note: for "proper claim" - see section 370
(form), section 371 (manner of lodgment) and section 372 (residence/presence
in Australia).

(2) For the purposes of subsection (1), where:

   (a)  a claim for widow B pension is made by or on behalf of a person; and

   (b)  at the time the claim is made, the claim cannot be granted because the
        person is not qualified for that pension; the claim is to be taken to
        have not been made.
