SOCIAL SECURITY ACT 1991 No. 46, 1991 - SECT 309

Bereavement payments on death of dependent or maintained child
309. If:

   (a)  a person is receiving a sole parent pension; and

   (b)  a dependent or maintained child of the person dies; and

   (c)  immediately before the child died, the person's sole parent pension
        rate included:

   (i)  a dependent child add-on in respect of the child; or

   (ii) guardian allowance in respect of the child; and

   (d)  the child was not the only SPP child of the person; the person is
        qualified for payments under this Subdivision to cover the bereavement
        period. Note 1: section 310 provides for sole parent pension to be
        paid to the person, up to the first available bereavement adjustment
        payday, at the rate at which it would have been paid if the child had
        not died but were disregarded for the purposes of working out the
        person's income test free areas. Note 2: section 311 provides for a
        lump sum to be paid to the person if the person was receiving family
        allowance for the child and the first available bereavement adjustment
        payday occurs before the end of the bereavement period: the lump sum
        represents the difference, over the bereavement lump sum period,
        between the person's new sole parent pension rate and the rate at
        which the pension would have been paid if the child had not died but
        were disregarded for the purposes of working out the person's income
        test free areas. Note 3: the additional payments preserved by this
        Subdivision are:
. dependent child add-on;
. guardian allowance;
. additional rent assistance;
. additional remote area allowance.
